The Use of Animals to Shield Unlawful Activities Act

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

The following definitions apply in this Act.

"property" means any real property. (« bien »)

"unlawful act" means an act or omission that is an offence under an Act of Canada or Manitoba. (« acte illégal »)

Offence — use of animals to protect property used for unlawful acts

2(1)

No person who is committing an unlawful act on a property shall use an animal to protect that property.

Interpretation

For the purpose of subsection (1), an animal is protecting a property if the animal poses a threat to a person who enters the property, having regard to

(a) the species or breed of animal;

(b) the size and temperament of the animal; and

(c) the location of the animal, and whether it is confined or restrained in any manner.

Penalty

A person who contravenes subsection 2(1) is guilty of an offence and is liable on summary conviction to a fine of not more than $5,000, or to imprisonment for a term of not more than three months, or both.

This Act may be referred to as chapter U90 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

This Act comes into force on the day it receives royal assent.
