The Upper Fort Garry Heritage Provincial Park Act
(Assented to June 17, 2010)
WHEREAS Upper Fort Garry played a critical role in the development of the Red River Settlement and the creation of Manitoba as a province;
AND WHEREAS it is important to preserve and protect parts of the site of Upper Fort Garry in order to promote the historical significance of Upper Fort Garry and ensure that appropriate development occurs on the site;
AND WHEREAS establishing a provincial park on parts of the site of Upper Fort Garry will protect this important piece of Manitoba's history and promote public awareness and appreciation of it;
THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
The following definitions apply in this Act.
"advisory committee" means the committee established by section 4. (« comité consultatif »)
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)
"park" the means Upper Fort Garry Heritage Provincial Park established by section 2. (« parc »)
Upper Fort Garry Heritage Provincial Park
Upper Fort Garry Heritage Provincial Park is hereby established, consisting of
(a) all those portions of River Lot 1, Parish of St. John, shown on Plan of Survey No. 20424 filed in the Winnipeg office of the Director of Surveys appointed under The Surveys Act; and
(b) any additional lands designated by regulation.
The park is, for all purposes, deemed to be a provincial park under The Provincial Parks Act.
For the purpose of subsection 7(2) of The Provincial Parks Act, the park is classified as a heritage park.
For the purpose of subsection 7(3) of The Provincial Parks Act, all land in the park is categorized in the heritage land use category.
The Upper Fort Garry Heritage Provincial Park advisory committee is hereby established.
The advisory committee is to consist of at least five and no more than ten persons appointed by the minister, a majority of whom must be selected from a list of persons recommended by the Friends of Upper Fort Garry Inc.
The advisory committee is to make recommendations to the minister about the park, including recommendations respecting
(a) the preservation of historic resources in the park;
(b) the development of the park; and
(c) the development of interpretative programming for the park.
The Lieutenant Governor in Council may make regulations
(a) designating additional lands as part of the park;
(b) respecting any matter necessary or advisable to carry out the purposes of this Act.
Consequential amendment, C.C.S.M. c. P20
The definition "provincial park" in section 1 of The Provincial Parks Act is amended by adding "and Upper Fort Garry Heritage Provincial Park established under The Upper Fort Garry Heritage Provincial Park Act" at the end.
This Act may be referred to as chapter U80 of the Continuing Consolidation of the Statutes of Manitoba.
This Act comes into force on a day to be fixed by proclamation.
