The Civil Remedies Against Organized Crime Amendment Act
(Assented to June 17, 2010)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
The Civil Remedies Against Organized Crime Act is amended by this Act.
Subsection 1(1) is amended
(a) by repealing the definition "police chief"; and
(b) by adding the following definition:
"director" means the person appointed under The Civil Service Act as the director for the purposes of this Act; (« directeur »)
Subsection 3(1) is amended
(a) by striking out "a police chief is satisfied that a respondent" and substituting "the director is satisfied that a person"; and
(b) by striking out "the police chief" and substituting "the director".
Subsection 4(1) is amended
(a) in the part before clause (a), by striking out "A police chief" and substituting "The director"; and
(b) in clause (a), by striking out "the respondent" and substituting "a person".
Subsection 5(1) is amended
(a) by striking out "a police chief is satisfied that the respondent owns or manages a business that, to the knowledge of the respondent" and substituting "the director is satisfied that a person owns or manages a business that, to the knowledge of the person"; and
(b) by striking out "the police chief" and substituting "the director".
Subsection 6(1) is amended
(a) in the part before clause (a), by striking out "a police chief" and substituting "the director";
(b) in clause (a), by striking out "the respondent" and substituting "a person";
(c) in clause (b), by striking out "the respondent" and substituting "the person"; and
(d) in the part after clause (c),
(i) by striking out "police chief" and substituting "director", and
(ii) by striking out "respondent's" and substituting "person's".
Subsection 6(4) is amended by striking out "a police chief" and substituting "the director".
Subsection 7(1) is amended by striking out "police chief" and substituting "director".
Section 14 is amended by striking out "the police chief who made the application may serve the order" and substituting "the director may arrange for the order to be served".
Section 15 is amended by striking out "an applicant" and substituting "the director".
Consequential amendment, S.M. 2009, c. 32 (unproclaimed amendment repealed)
Section 94 of The Police Services Act is repealed.
This Act comes into force on a day to be fixed by proclamation.
