The Capital Region Partnership Act

WHEREAS a prosperous capital region, consisting of the City of Winnipeg and surrounding municipalities, is essential for the well-being of the province as a whole;

AND WHEREAS a co-ordinated and co-operative approach will ensure that the core of the capital region is enhanced while still allowing opportunities in other areas of the region;

AND WHEREAS it is desirable to encourage the leaders of the capital region to work together to promote co-ordinated land use planning, economic development and the protection of the environment, including the protection of water resources, in the region within the existing legislative framework;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definition

In this Act, "minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act.

Purpose

The purpose of this Act is to facilitate the creation of an organization to be known as the Capital Region Partnership, with the following mandate:

(a) to create a forum to discuss and develop regional solutions to common issues facing municipal governments in the capital region, such as

(i) land use planning,

(ii) infrastructure development,

(iii) environmental protection, and

(iv) water quality and supply;

(b) to promote co-operation between partnership members in delivering services and developing infrastructure in the capital region;

(c) to promote tourism and sustainable economic development in the capital region;

(d) to share information among partnership members;

(e) to conduct research on issues affecting the capital region;

(f) to foster public awareness about issues affecting the capital region.

Municipalities to develop recommendations

3(1)

The mayors and reeves of the following municipalities must meet and develop recommendations for the minister respecting the membership, organization and governance structure of the Capital Region Partnership:

(a) the Rural Municipality of Cartier;

(b) the Rural Municipality of East St. Paul;

(c) the Rural Municipality of Headingley;

(d) the Rural Municipality of Macdonald;

(e) the Rural Municipality of Ritchot;

(f) the Rural Municipality of Rockwood;

(g) the Rural Municipality of Rosser;

(h) the Rural Municipality of Springfield;

(i) the Rural Municipality of St. Andrews;

(j) the Rural Municipality of St. Clements;

(k) the Rural Municipality of St. Francois Xavier;

(l) the Rural Municipality of Tache;

(m) the Rural Municipality of West St. Paul;

(n) the Town of Stonewall;

(o) the City of Selkirk;

(p) the City of Winnipeg.

Report

The mayors and reeves must submit their recommendations to the minister in the form of a report.

Recommendations re membership

The report may recommend that the membership of the Capital Region Partnership include

(a) some or all of the municipalities listed in subsection (1); and

(b) other municipalities not listed in subsection (1), after they have been consulted.

Involvement in report

3(4)

The report may be made even if the mayor or reeve of a municipality listed in subsection (1) does not participate in the development of the recommendations.

Role of the minister

4(1)

If, after considering the report, the minister is satisfied that

(a) the proposed membership of the Capital Region Partnership is representative of the capital region;

(b) the proposed organizational and governance structure of the Capital Region Partnership recognizes the size and population of the City of Winnipeg and its significant role in the capital region; and

(c) the proposed membership and organizational structure of the Capital Region Partnership will enable regional solutions to be found to issues facing the capital region, such as land use planning, infrastructure development, environmental protection and water quality and supply;

the minister may recommend to the Lieutenant Governor in Council that the Capital Region Partnership be established.

Regulations

4(2)

After considering the minister's recommendations, the Lieutenant Governor in Council may make regulations

(a) establishing the Capital Region Partnership;

(b) specifying the members of the Capital Region Partnership;

(c) respecting the organizational and governance structure of the Capital Region Partnership;

(d) respecting the manner in which the Capital Region Partnership is to carry out its mandate;

(e) respecting reports to be made by the Capital Region Partnership, including annual reporting on its goals and the extent to which those goals have been achieved;

(f) respecting any other matter necessary or advisable to carry out the purposes of this Act.

Coming into force

6

This Act comes into force on a day to be fixed by proclamation.
