THE SECURITIES AMENDMENT AND COMMODITY FUTURES AND CONSEQUENTIAL AMENDMENTS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. S50 amended

1(1)

The Securities Act is amended by this section.

1(2)

Section 16 is repealed.

1(3)

Section 17 is repealed and the following is substituted:

Refunds

Where an application for a registration is refused, a registration is cancelled or a receipt for a prospectus is not obtained, the director may cause the fee paid in respect of the matter,  or any part of the fee that the director considers fair and reasonable, to be refunded.

S.M. 1996, c. 73 amended

Section 64 of The Commodity Futures and Consequential Amendments Act, as enacted by S.M. 1996, c. 73,  is amended by striking out everything after ", at the request of the applicant," and substituting "cause the fee, or any part of the fee that the director considers fair and reasonable, to be refunded."

Coming into force

This Act is retroactive and is deemed to have come into force on April 1, 1999.
