THE NATURAL GAS SUPPLY REPEAL AND PUBLIC UTILITIES BOARD AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

PART 1

THE NATURAL GAS SUPPLY ACT

C.C.S.M. c. N15 repealed

The Natural Gas Supply Act, S.M. 1987-88, c. 65, is repealed.

PART 2

THE PUBLIC UTILITIES BOARD ACT

C.C.S.M. c. P280 amended

The Public Utilities Board Act is amended by this Part.

Section 112 is amended by repealing the definition "direct purchase of gas".

4(1)

Subsection 115(3) is amended by striking out "Subject to subsection (4), the Board" and substituting "The Board".

4(2)

Subsection 115(4) is repealed.

Subsection 116(2) is repealed.

Section 117 is repealed.

Section 119 is amended by striking out "the minister under The Natural Gas Supply Act, the Board or any member thereof, nor any person designated as a purchasing agent under The Natural Gas Supply Act" and substituting "the Board or any member thereof".

Subsection 120(3) is amended

(a) by striking out ", a direct purchasing agent"; and

(b) by striking out "including an amount for the commodity cost fixed by the Lieutenant Governor in Council under section 29 of The Natural Gas Supply Act, or as may be otherwise set by the Board" and substituting "set by the Board".

Section 125 is amended by striking out "any applicant, intervenor, the minister under The Natural Gas Supply Act" and substituting "an applicant or intervenor".

Subsections 126(3) and (4) are repealed.

This Act comes into force on the day it receives royal assent.
