THE HIGHWAY TRAFFIC AMENDMENT (LIGHTING ON AGRICULTURAL EQUIPMENT) ACT


 

(Assented to November 19, 1996)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Highway Traffic Act is amended by this Act.

Subsection 1(1) is amended

(a) in the definition "implement of husbandry", by striking out "machine that is not a motor vehicle and" and substituting "vehicle";

(b) in the definition "motor vehicle", by striking out  "a self-propelled implement of husbandry" and substituting "an implement of husbandry";

(c) in the definition "trailer", by striking out ", propelled, or moved"; and

(d) in the definition "vehicle", by striking out everything after "upon a highway" and substituting the following :

but does not include

(a) a device designed to be moved by human muscular power or used exclusively upon stationary rails or tracks, or

(b) a motorized mobility aid;

The following is added before section 35 as part of Part III:

Application of s. 35 to 37 to agricultural equipment

34.1

Sections 35 to 37 do not apply to a tractor or an implement of husbandry.

4(1)

Subsection 35(1) is amended

(a) in the part preceding clause (a), by striking out "Subject to section 36, to subsection (7) and to section 149" and substituting "Except as otherwise provided in this Act";

(b) in clause (a), by striking out "other than a motorcycle and every tractor, self-propelled implement of husbandry" and substituting " other than a motorcycle, mobility vehicle or moped"; and

(c) in clause (l),

(i) in the part preceding subclause (i),

(A) by striking out "an implement of husbandry or" and substituting "a", and

(B) by striking out "the implement or mobile machine, as the case may be,"and substituting "the special mobile machine", and

(ii) in subclauses (i) and (ii), by striking out "implement or"and substituting "special".

4(2)

Subsection 35(7) is amended

(a) in the section heading, by striking out "tractors, implements of husbandry and"; and

(b) in the subsection, by striking out "tractor, self-propelled implement of husbandry or".

4(3)

Subsection 35(18) is repealed and the following is substituted:

Beacons on farm trucks

35(18)

A truck registered as a farm truck may be equipped with an amber oscillating lamp.

Subsection 178(1) is amended by striking out "any implement of husbandry or".

The following is added after subsection 180(1):

Prohibition re operating beacons

180(1.1)

No person shall drive a farm truck on a highway while it is equipped with an amber oscillating lamp that is illuminated unless the farm truck is

(a) being used for the transportation of produce, a product, a commodity or property described in clause (2)(a), (b), (c) or (e); or

(b) towing a vehicle.

Subsection 319(1) is amended

(a) by adding the following as clause (a.1):

(a.1) classifying vehicles for any purpose of the regulations;

(b) by repealing clause (d) and substituting the following:

(d) respecting the design, position, standards and other requirements of lamps and other lighting equipment and reflectors and other markings on vehicles for which no provision or no sufficient provision is made under this Act,

(d.1) respecting the use of lamps and other lighting equipment and reflectors and other markings on vehicles on a highway;

(d.2) respecting pilot or escort vehicles and their use in relation to tractors and implements of husbandry on a highway;

(c) in subclause (mm)(i), by adding "and other markings" after "reflectors".

Coming into force

This Act comes into force on a day fixed by proclamation.
