THE MUNICIPAL ASSESSMENT AMENDMENT AND ASSESSMENT VALIDATION ACT
(Assented to October 22, 1996)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
The Municipal Assessment Act is amended by this Act.
Clause 6(1)(a) is amended by striking out "and pipelines" and substituting ", pipelines and gas distribution systems".
Section 19 is repealed and the following is substituted:
Assessing the value of a railway roadway, pipeline or gas distribution system
In assessing a railway roadway, pipeline or gas distribution system, an assessor shall determine the value by applying the assessment rates prescribed under clause 6(1)(a).
Section 36 is amended by renumbering it as subsection 36(1) and by adding the following as subsection 36(2):
A board may determine the rules of practice and procedure to govern the conduct of business before the board or a panel of the board, but the rules do not come into force until approved by the council of the municipality.
The section heading for subsection 42(2) is repealed and "No revision re railway roadway, pipeline or gas distribution system" is substituted.
In assessing a gas distribution system in a municipality for 1994 to 1997, an assessor shall assess
(a) $160. for each gasometer;
(b) $450. for each pipe connecting to one or more gasometers;
(c) each regulator station at the cost of construction, indexed and depreciated to 1991; and
(d) each pipe, other than a pipe referred to in clause (b), on the basis of length and outside diameter, at the following rates:

The assessment of a gas distribution system for 1994 to 1997 made in accordance with subsection (1) is hereby declared to be valid and binding on all persons affected by the assessment, and no person may challenge an assessment made in accordance with subsection (1).
For greater certainty, subsection (2) applies to any assessment of a gas distribution system that is the subject of an application for revision or an appeal made before or after this Act comes into force, whether or not a decision is or has been rendered.
This Act comes into force on the day it receives royal assent.
