The Manitoba Historical Society Property Act

WHEREAS The Historical and Scientific Society of Manitoba was incorporated by An Act to incorporate the Historical and Scientific Society of Manitoba, assented to June 25, 1879;

AND WHEREAS that Act was not included in the roll to the Re-enacted Statutes of Manitoba (Private Acts) Act, 1990, and was repealed by The Private Acts Repeal Act, assented to November 14, 1990;

AND WHEREAS, notwithstanding its legal dissolution by virtue of that repeal, the activities of The Historical and Scientific Society of Manitoba have continued and are continuing under its commonly known name, the Manitoba Historical Society;

AND WHEREAS by virtue of its legal dissolution, the property of The Historical and Scientific Society of Manitoba vested in Her Majesty in right of Manitoba pursuant to The Corporations Act;

AND WHEREAS Douglas Taylor, William J. Fraser and Lily B. Stearns have, on behalf of the Manitoba Historical Society, by petition prayed that The Manitoba Historical Society Incorporation Act be enacted;

AND WHEREAS it is considered expedient to confirm, upon the enactment of The Manitoba Historical Society Incorporation Act, that the property of The Historical and Scientific Society of Manitoba is the property of the Manitoba Historical Society notwithstanding the repeal of An Act to incorporate the Historical and Scientific Society of Manitoba;

NOW THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

In this Act,

"existing society" means the association carrying on its activities under the name the "Manitoba Historical Society" on the day before the day on which this Act comes into force; (« société existante »)

"Manitoba Historical Society" means the Manitoba Historical Society incorporated pursuant to The Manitoba Historical Society Incorporation Act. (« Société historique du Manitoba »)

Property restored

The Manitoba Historical Society is hereby vested with all of the property, rights, privileges and franchises of The Historical and Scientific Society of Manitoba that vested in Her Majesty in right of Manitoba on November 14, 1990, subject to all of the liabilities of The Historical and Scientific Society of Manitoba, as at November 13, 1990.

Decisions confirmed

All decisions made or actions taken by the existing society or by its officers or employees on its behalf with respect to the property of The Historical and Scientific Society of Manitoba that vested in Her Majesty in right of Manitoba on November 14, 1990, in the period from November 14, 1990 to the day this Act comes into force, are valid and enforceable as if The Manitoba Historical Society Incorporation Act and this Act had been in force during that period.

This Act comes into force on the day on which The Manitoba Historical Society Incorporation Act comes into force.
