The Statute Law Amendment Act, 1994
(Assented to July 5, 1994)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
THE BRANDON CHARTER ACT
The Brandon Charter Act is amended by this section.
Section 7 is renumbered as subsection 7(1) and the following is added as subsection 7(2):
Councillor need not reside in ward
Subclause 46(d)(ii) of The Municipal Act does not apply to councillors or candidates to become councillors of the city, and any resident of the city who meets the other qualifications set out in the other provisions of The Municipal Act for members of council and who is not disqualified from being a councillor under any other provision of The Municipal Act, is qualified to be a councillor in any ward of the city.
Everything done before the coming into force of this section, that would have been valid had subsection 1(2) been in force at that time, is validated and declared to have been lawfully done.
THE CIVIL SERVICE SUPERANNUATION ACT
Subsection 9(2) of The Civil Service Superannuation Act is amended by striking out everything after "The Pension Benefits Act".
THE CORPORATIONS ACT
The Corporations Act is amended by this section.
Clause 26(3)(b) of the English version is amended by adding ", to" before "shareholders".
The following is added after section 199.2 and as part of Part XVI:
Application for Supplementary Registration
Notwithstanding subsection 194(1) and clause 199.2(e), where the business authorization of a body corporate under Part XXIV is revoked because the body corporate has been continued as a kind of body corporate to which Part XXIV does not apply, the registration of the body corporate under this Part shall not be cancelled immediately but shall be cancelled on the expiry of a period of 30 days after the revocation of its business authorization unless it sooner files an Application for Supplementary Registration.
Subsection 267(2) is amended in the part following clause (d) by striking out "Minister of Industry and Commerce" and substituting "Minister of Rural Development".
Subsections 316(2) and 317(1) of the English version are amended by striking out "The Canada Deposit Insurance Corporation Act" and substituting "the Canada Deposit Insurance Corporation Act".
Section 361 is amended by striking out "the business of a trust corporation or loan corporation" and substituting "business"
(a) in subsection (1); and
(b) in subsection (2), in the part preceding clause (a).
Subsection 368(1) is repealed and the following is substituted:
Where an extra-provincial corporation with a business authorization amalgamates with
(a) one or more extra-provincial corporations with or without business authorizations; or
(b) one or more bodies corporate incorporated outside of Manitoba;
and continues as an extra-provincial corporation, the amalgamated extra-provincial corporation shall apply for a business authorization within seven days after the effective date of the amalgamation.
Clauses 372(2)(a) and (b) of the French version are amended by striking out "rapport financier" and substituting "compte rendu".
Clause 374(2)(c) of the French version is amended by striking out "l'enjoint" and substituting "lui enjoint".
Subsection 374(3) of the French version is amended by striking out "au Canada ou tout ordre qui y est donné par une personne" and substituting "ou tout ordre donné par une personne au Canada".
THE CREDIT UNIONS AND CAISSES POPULAIRES ACT
The Credit Unions and Caisses Populaires Act is amended by this section.
Section 1 is amended
(a) by repealing the definitions "Fonds de sécurité" and "Stabilization Fund"; and
(b) by repealing the definitions "fund" and "system" and substituting the following in alphabetical order:
"fund" means The Credit Union Deposit Guarantee Corporation or the Société d'assurance-dépôts des caisses populaires, as the context may require; (« fonds »)
"system" means
(a) CCSM and The Credit Union Deposit Guarantee Corporation, and the credit unions assigned to them, or
(b) Fédération and the Société d'assurance-dépôts des caisses populaires, and the caisses populaires assigned to them,
as the context may require. (« système »)
Subsection 10(1) is amended by striking out "the Stabilization Fund," and substituting "The Credit Union Deposit Guarantee Corporation".
Subsection 10(2) is amended by striking out "the Fonds de sécurité" and substituting "the Société d'assurance-dépôts des caisses populaires".
Section 158 is amended
(a) by striking out "the Stabilization Fund" and substituting "The Credit Union Deposit Guarantee Corporation"; and
(b) by striking out "Le Fonds de sécurité" and substituting "the Société d'assurance-dépôts des caisses populaires".
THE EMERGENCY MEASURES ACT
Clause 12(f) of the French version of The Emergency Measures Act is amended by striking out "atteinte d'une" and substituting "frappée par une".
THE ENVIRONMENT ACT
The Environment Act is amended by this section.
The French version of subsection 8(1) is amended by striking out "de protection".
The French version of section 45.1 is amended by striking out "fonds" and substituting "Fonds"
(a) in subsections (2) and (3), in the subsections and in the section headings; and
(b) in subsection (4), in the part preceding clause (a).
THE FARM PRACTICES PROTECTION ACT
Clause 2(2)(d) of the French version of The Farm Practices Protection Act is amended by striking out "d'une terre près du sol" and substituting "du sol près de celui".
THE FATALITY INQUIRIES ACT
Subclause 7(9)(a)(x) of the French version of The Fatality Inquiries Act is repealed and the following is substituted:
(x) par suite d'une maladie ou d'un état pathologique qu'elle a contracté à son lieu ou son ancien lieu de travail, d'une blessure qu'elle y a subie ou de l'ingestion d'une substance toxique à cet endroit,
THE MANITOBA FOUNDATION ACT
The Manitoba Foundation Act is amended by this section.
Section 2 of the French version is amended by striking out "créé" and substituting "créée".
Subsection 8(3) is amended by striking out "each category of institution set out in clauses (a) to (c)" and substituting "that category".
THE HEALTH SERVICES INSURANCE ACT
Subsection 104(2) of the English version is amended by striking out "of his of her" and substituting "of his or her".
THE JURY ACT
Subsection 19(2) of the English version of The Jury Act is amended by striking out "distict" and substituting "district".
THE LIQUOR CONTROL ACT
Section 141 of The Liquor Control Act is amended by striking out "167" and substituting "140".
THE MARRIAGE ACT
The Marriage Act is amended by this section.
Subsection 9(2) of the English version is amended by striking out "licencehas" and substituting "licence has".
Subsection 21(1) is amended in the part preceding clause (a)
(a) by striking out "shall personally attend" and substituting "shall personally attend at the same time"; and
(b) by striking out "each severally make" and substituting "shall each, in the presence of the other, severally make".
THE MUNICIPAL ASSESSMENT ACT
The Municipal Assessment Act is amended by this section.
Subsection 56(5) is amended by striking out "62(1)" and substituting "62(2)".
Section 65 is amended by striking out "S.M. 1970, c. 33" and substituting "R.S.M. 1988, c. M226"
(a) in clause (1)(a); and
(b) in subsection (2).
THE OIL AND GAS AND CONSEQUENTIAL AMENDMENTS ACT
The Oil and Gas and Consequential Amendments Act is amended by this section.
Subsection 171(1) of the French version is amended by striking out "que la licence ou le permis soit annulé ou non".
Clause 217(1)(h) of the French version is amended by striking out "l'utlisation" and substituting "l'utilisation".
THE MANITOBA PUBLIC INSURANCE CORPORATION ACT
The Manitoba Public Insurance Corporation Act is amended by this section.
Subsection 79(2) is amended by adding "under this Part" after "compensation".
Section 99 is amended by striking out "65" and substituting "66".
THE SOCIAL ALLOWANCES ACT
The French version of clause 19(1)(d) of The Social Allowances Act is amended by striking out "bénéficaire" and substituting "bénéficiaire".
THE INTERNATIONAL TRUSTS ACT
Article 2 of the Schedule to the English version of The International Trusts Act is amended by striking out "beneficially" and substituting "beneficiary".
THE VITAL STATISTICS ACT
Subclause 14(6)(a)(x) of the French version of The Vital Statistics Act is repealed and the following is substituted:

COMING INTO FORCE
Subject to subsections (2), (3), (4), (5), (6) and (7), this Act comes into force on the day it receives royal assent.
Coming into force of section 8
Section 8 is retroactive and is deemed to have come into force on May 14, 1990.
Coming into force of section 14
Section 14 is retroactive and is deemed to have come into force on January 1, 1990.
Coming into force of section 15
Section 15 comes into force on July 1, 1994 and in the event that this Act receives royal assent after that date, section 15 is retroactive and is deemed to have come into force on July 1, 1994.
Coming into force of section 16
Section 16 is retroactive and is deemed to have come into force on March 1, 1994.
Coming into force of section 18
Section 18 comes into force on the day on which The International Trusts Act, S.M. 1993, c. 12, comes into force.
Coming into force of section 19
Section 19 is retroactive and is deemed to have come into force on February 1, 1988.
