The Convention Centre Corporation Amendment Act

(Assented to July 5, 1994)

HER MAJESTY, by and with the consent of the Legislative Assembly of Manitoba, enacts as follows:

The Convention Centre Corporation Act is amended by this Act.

Clause 6(1)(b) is amended by striking out "$100,000." and substituting "$250,000.".

Subsection 11(1) is amended by striking out "13" and substituting "15".

Subsection 11(5) is repealed and the following is substituted:

Directors

11(5)

Unless otherwise determined under this Act, the board shall comprise the following members of the corporation:

(a) four members of the Council of The City of Winnipeg appointed by the Council of The City of Winnipeg;

(b) seven persons from The City of Winnipeg appointed by the Council of The City of Winnipeg;

(c) two members appointed by the board; and

(d) two persons appointed by the Lieutenant Governor in Council.

Term of councillors

11(6)

Directors who are appointed under clause (5)(a) shall be appointed to hold office for a term of one year.

Term of other directors

11(7)

Except as provided in subsections (6) and (11), every director shall be appointed to hold office for a term of two years.

Incomplete term of office

11(8)

A successor shall be appointed to replace a director for the remainder of his or her term of office if the director is unable or unwilling to complete that term.

Maximum consecutive years of service

11(9)

Except as provided in subsection (10),

(a) a director appointed under clause (5)(a) is eligible to serve on the board for a maximum of six consecutive years; and

(b) a director appointed under clause (5)(b), (c) or (d) is eligible to serve on the board for a maximum of three consecutive terms or six consecutive years, whichever is less.

Reappointment after period of absence

11(10)

A member or person who has served the maximum consecutive years of service as a director is eligible to be reappointed as a director after a period of absence from the board of one term.

Transitional:  staggered terms of appointment

11(11)

As soon as possible after the coming into force of this subsection, directors shall be appointed under clauses (5)(b), (c) and (d) to hold office from the first annual meeting following the coming into force of this subsection in accordance with the following rules:

(a) of the seven persons appointed under clause (5)(b), three shall be appointed for a term of one year and four shall be appointed for a term of two years;

(b) of the two persons appointed under clause (5)(c), one shall be appointed for a term of one year and one shall be appointed for a term of two years;

(c) of the two persons appointed under clause (5)(d), one shall be appointed for a term of one year and one shall be appointed for a term of two years;

and, on the expiry of the terms of persons appointed in accordance with this subsection, appointments shall be made in accordance with subsection (7).

Transitional:  present directors

11(12)

A director who holds office on the coming into force of this section continues to hold office until his or her successor is appointed or until he or she is reappointed in accordance with the rules set out in this section.

This Act comes into force on the day it receives royal assent.
