The Workers Compensation Amendment Act

(Assented to October 4, 1989)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Workers Compensation Act is amended by this Act.

Various provisions amended

In the following provisions, "$751." is struck out, and "$816." is substituted:

(a) subsections 1(4), (5) and (6), 40(5) and 43(1);

(b) clauses 28(1)(a), (b) and (d), 28(2)(a), (b) and (c); and

(c) section 37.

Clause 28(1)(b) amended

Clause 28(1)(b) is amended by striking out "$169." and substituting "$184."

Clauses 28(1)(c) and (e) amended

Clauses 28(1)(c) and (e) are amended by striking out "$188." and substituting "$204."

Subclause 28(1)(e)(v) amended

Subclause 28(1)(e)(v) is amended by striking out "$208." and substituting "$226."

Subclause 28(1)(f)(i) amended

Subclause 28(1)(f)(i) is amended by striking out "$152." and substituting "$165."

Subclause 28(1)(f)(ii) amended

Subclause 28(1)(f)(ii) is amended by striking out "$303." and substituting "$329."

Section 38 amended

Section 38 is amended:

(a) by striking out "1985" in the heading and in the section, and substituting "1989"; and

(b) by striking out "not less than $751. per month." and substituting ", after applying any increase in compensation to which the person may be entitled under section 39, not less than $816."

Sections 39 and 39.1 rep. and sub.

Sections 39 and 39.1 are repealed and the following is substituted:

Payment increase for pre-1987 accident

Where, as of June 30, 1989, a person is receiving or is entitled to receive a periodic payment under this Part as compensation in respect of a permanent disability arising from an accident that happened before January 1, 1987, the amount of the periodic payment shall, as of July 1, 1989, be increased above the amount of the periodic payment to which the person was entitled as of June 30, 1987, as the Act was on that date:

(a) where the accident happened before January 1, 1986, by 8.6%;

(b) where the accident happened after December 31, 1985, and before January 1, 1987, by 4.8%.

Section 41 amended

Section 41 is amended:

(a) by striking out "1985" in the heading and in the section, and substituting "1989"; and

(b) by striking out "not less than that percentage of $751."and substituting", after applying any increase in compensation to which the person may be entitled under section 39, not less than that percentage of $816."

Subsection 43(2) amended

Subsection 43(2) is amended:

(a) by striking out "1985" in the heading and in the section, and substituting "1989"; and

(b) by striking out "$751." and substituting "$816."

Coming into force

This Act is deemed to have come into force on July 1, 1989.
