The Centennial Projects Tax Status Act

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definition of "centennial project"

In this Act

"centennial project" means

(a) the centennial centre as that term is defined in The Centennial Centre Corporation Act;

(b) the lands owned by the Crown in right of Manitoba or by Manitoba Properties Inc. within the area at the south-east-corner of Avenue Provencher and Rue des Meurons in the City of Winnipeg and all buildings and structures erected thereon and used or to be used for the purposes of Le Centre Culturel Franco-Manitobain including any lands and buildings thereon the title to which may be acquired for purposes of Le Centre Culturel Franco-Manitobain;

(c) the lands, including all buildings and structures thereon, owned by the Winnipeg Art Gallery within the area bounded in the east by Memorial Boulevard, on the north-west by Colony Street, and on the south by St. Mary Avenue, in the City of Winnipeg, and used or held for the purposes of an Art Gallery;

(d) the lands, including all buildings and structures thereon or to be erected thereon, now or hereafter owned by The Royal Winnipeg Ballet or any corporation which it causes to be incorporated for the purpose of holding title thereto, within the area in The City of Winnipeg bounded on the West by Edmonton Street on the South by St. Mary Avenue on the East by Carlton Street and on the North by Graham Avenue, and used or held for the purposes of The Royal Winnipeg Ballet;

(e) the lands, including all buildings and structures thereon, commonly known as 184 Alexander Avenue in the City of Winnipeg, owned by the Ukrainian Cultural and Educational Centre and used for the purposes of a cultural and educational centre; and

(f) that portion of the lands, including all buildings and structures thereon, commonly known as Portage Place and situated within the area in The City of Winnipeg bounded on the south by Portage Avenue, on the west by Vaughan Street, on the north by Ellice Avenue and on the east by Carlton Street, leased to and occupied by Prairie Theatre Exchange and used or held for the purposes of Prairie Theatre Exchange.

Exemption

Section 2 does not apply to a tax imposed on a person attending a performance, exhibition or display in a centennial project and based on the amount of fee or charge paid by the person in respect of his attendance.

Grants in lieu

Notwithstanding any other Act of the Legislature, the government shall not make any grant in lieu of taxes to a municipality in respect of a centennial project.

Transfer of title

Where a centennial project ceases to be used for the purposes for which it was constructed, the owner thereof shall transfer title thereto to the government.

Restriction on transfer

The owner or operator of a centennial project shall not transfer title to the centennial project, or encumber the title to the centennial project in any manner without the prior approval of the Lieutenant Governor in Council; and any purported transfer or encumbrance of a centennial project that is not approved by the Lieutenant Governor in Council is void.
