The Interim Appropriation Act, 1987 (2)

(Assented to June 12, 1987)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definition of "Main Estimates".

In this Act "Main Estimates" refers to The Main Estimates of Expenditure of the Province of Manitoba for the fiscal year ending March 31, 1988, as laid before the Legislative Assembly at the present session of the Legislature.

Money Granted for the fiscal year ending March 31, 1988.

Subject to section 5 of The Interim Appropriation Act, 1987, being chapter 3 of the Statutes of Manitoba, 1987, from and out of the Consolidated Fund of the province there may be paid and applied a sum of $1, 688, 190, 840. towards defraying the several charges and expenses of the public service of the province not otherwise provided for, and being 45% of the total amount to be voted as set forth in the Main Estimates.

Authority for commitments for future years.

3(1)

In addition to expenditure authority granted under section 2, authority is granted to the government to commit expenditures not to exceed in total an estimated aggregate amount of $210, 000, 000. for the purposes of ensuring completion of projects or fulfilling of contracts initiated prior to and during the fiscal year ending March 31, 1988, regardless of the year in which the expenditures will be made in respect of those commitments, but the expenditures for those commitments shall not be made in the fiscal year ending March 31, 1988, without additional expenditure authority being granted.

Voting of funds in subsequent years.

3(2)

The estimated amount of expenditures which have been committed under subsection (1) shall be included in the estimates of the fiscal year in which the expenditures are expected to be made.

Limitation on expenditure for items.

The amount that may be paid and applied under the authority of this Act in respect of any of the several items to be voted for departments as set forth in the Main Estimates shall not exceed the amount set out for that item in those estimates.

Effect of passing of main appropriations.

When an Act, other than this Act, for granting to Her Majesty certain sums of money for the public service of the province for the fiscal year ending the 31st day of March, 1988 and to authorize commitments to expend additional money in subsequent years is passed at the present session of the Legislature, expenditures and commitments made under the authority of this Act shall be deemed to have been made under the authority of that other Act, and this Act shall cease to have effect on the coming into force of that other Act.

Transfer of certain funds to several departments.

6(1)

The Minister of Finance may, at his discretion, transfer for the same purposes to any appropriation under any service heading of the Main Estimates any part or all of the money the expenditure of which, for the Canada-Manitoba Enabling Vote is to be authorized under service heading Canada-Manitoba Enabling Vote (XXVI) and in Appropriation No. 1 - Canada-Manitoba Enabling Vote under that heading.

Adjustments in Main Estimates.

Where money is transferred under subsection (1), adjustments shall be made in the Main Estimates in accordance with the directives which are contained in Acts other than this Act, for granting to Her Majesty sums of money for the public service of the province for that fiscal year and which relate to similar types of transfers.

Authority for expenditure in anticipation of recoveries.

Where an item in an appropriation for a department of government as shown in the Main Estimates showed that a nil amount or a net amount of expenditure was to be authorized for the purpose of the department rendering services or providing materials, supplies or property to another department or agency of the government, on the basis that all or a portion of the total amount to be expended by the first mentioned department for those purposes would be recovered from that other department or other agency in anticipated amounts as set out in the item in the Main Estimates, the amount that may be expended through the first mentioned department for the purpose of rendering the services or providing the materials, supplies or property, in the fiscal year ending March 31, 1988, shall be the total of:

(a) the net amount voted in the item, whether or not it is a nil vote; and

(b) the anticipated amount of the recoveries as set out in the item in the Main Estimates to the extent that it is reasonably anticipated that the recoveries will be made.

Emergency Interest Rate Relief Program.

All money the expenditure of which is to be authorized under Appropriation No. 1 -Emergency Interest Rate Relief Program under service heading Emergency Interest Rate Relief (XXVIII) in the Main Estimates, may be expended under such sub-appropriations as may be established by the Minister of Finance under other department appropriations, on the basis that the total amount to be expended will be recovered from Appropriation No. 1 - Emergency Interest Rate Relief Program under service heading Emergency Interest Rate Relief (XXVIII) of the Main Estimates.

Manitoba Jobs Fund.

All money the expenditure of which is to be authorized under Appropriation No, 1 -Manitoba Jobs Fund under service heading Manitoba Jobs Fund (XXIX) in the Main Estimates, may be expended under such subappropriations as may be established by the Minister of Finance under other department appropriations, on the basis that the total amount to be expended will be recovered from Appropriation No. 1 - Manitoba Jobs Fund under service heading Manitoba Jobs Fund (XXIX) of the Main Estimates.

Money authorized for agreements with Canada.

10(1)

Money authorized under this Act to be expended for or in respect of any agreement with the Government of Canada may be expended in anticipation of the agreement being entered into notwithstanding that the agreement has not been, and never is, entered into.

Money expended in anticipation of agreements.

10(2)

Money authorized under this Act to be expended for or in respect of any agreement with the Government of Canada may be expended on projects or for costs in anticipation that the agreement when entered, will provide for the sharing of the amount expended or the sharing of certain costs of the project, notwithstanding that the agreement when entered does not provide for such sharing.

Application of money.

The due application of all money expended under the authority of this Act, and deemed to have been made under the authority of the other Act to which reference is made in section 5, shall be accounted for to Her Majesty.

Commencement of Act.

This Act comes into force on the day it receives the royal assent.
