An Act to amend The Retail Businesses Holiday Closing Act

(Assented to February 27, 1987)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Subsec. 4(1) rep. and sub.

Subsection 4(1) of The Retail Businesses Holiday Closing Act, chapter R120 of The Continuing Consolidation of the Statutes of Manitoba, is repealed and the following subsection is substituted therefor:

Sunday opening.

Notwithstanding sections 2 and 3 but subject to subsection (2), the owner or operator of a retail business establishment may sell or offer for sale goods or services on a Sunday in premises that were closed to the public and in which no goods or services were sold or offered for sale on the immediately preceding Saturday.

Clause 5(a) of the Act is repealed and the following clause is substituted therefor:

(a) to a hotel or a restaurant;.

Cl. 5(f) and (g) rep. and sub.

Clauses 5(f) and (g) of the Act are repealed and the following clauses are substituted therefor:

(f) to a retail business establishment where gasoline, motor oil and related goods or services for use in the operation of a motor vehicle are the only goods or services offered for sale;

(g) to a retail business establishment where nursery stock, flowers, garden supplies and accessories are the only goods offered for sale;.

Section 9 of the Act is repealed and the following section is substituted therefor:

Offence and penalty.

Any person who violates the provisions of this Act is guilty of an offence and is liable, in the case of a first offence, to a fine of not less than $1, 000. and not more than $10, 000. and, in the case of a subsequent offence occurring within two years of any previous offence, to a fine of not less than $10, 000. and not more than $50, 000.

Commencement.

This Act comes into force on the day it receives the royal assent but shall cease to have any force after June 30, 1987.

Revival.

5(2)

Effective July 1, 1987, the Act shall be deemed to read exactly as it read immediately prior to the coming into force of this Act.
