An Act to amend The Municipal Assessment Act and The City of Winnipeg Act

THE CITY OF WINNIPEG ACT

(Assented to September 10, 1986)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

PART I

THE MUNICIPAL ASSESSMENT ACT

Clause 31.1(2)(b) of The Municipal Assessment Act, as enacted by chapter 88 of the Statutes of Manitoba, 1982-83-84, is repealed.

Sec. 31.2 added.

The Act is further amended by adding immediately after section 31.1 thereof, the following section:

Defining classes of property.

31.2

The Lieutenant Governor in Council may make regulations defining classes of property on the basis of types and uses of land or buildings or both.

THE CITY OF, WINNIPEG ACT

Sec. 152 am.

Section 152 of The City of Winnipeg Act, chapter 105 of the Statutes of Manitoba, 1971, is amended by adding the following subsections:

Differential rates of taxation.

152(7)

Notwithstanding any other provision of this Act or of any other Act, the Council may, by by-law, establish differential rates of taxation for classes of property defined by regulations made pursuant to section 31.2 of The Municipal Assessment Act.

Approval of Lieutenant Governor in Council.

152(8)

No by-law passed by Council under subsection (7) has any force or effect until approved by the Lieutenant Governor in Council.

Deemed repeal of subsections (7) and (8).

152(9)

Subsections (7) and (8) shall be deemed to have been repealed on the day on which subsection 31.1(2) of The Municipal Assessment Act comes into force.

Commencement of Act.

This Act comes into force on a day fixed by proclamation.
