An Act to amend The Snowmobile Act

(Assented to September 10, 1986)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Subsec. 1(1) am.

Subsection 1(1) of The Snowmobile Act being chapter S150 of the Continuing Consolidation of the Statutes of Manitoba is amended

(a) by adding thereto immediately preceding the definition of" highway" the following definition:

"all-terrain vehicle" means an off-road vehicle that

(i) operates or travels on 3 or more low-pressure tires,

(ii) has a seat designed to be straddled by the operator of the vehicle, and

(iii) has handlebars for steering the vehicle; and

(b) by striking out from the subsection the following clause reference letters, brackets and figure:

"(a), (b), (c), (d), (e), (f), (g), (h), (h. l), (i), (j) and (k)".

The definition of "snowmobile" in subsection 1(1) is amended by striking out the words "a motorcycle that has three wheels and that is not registered under The Highway Traffic Act" in the 10th and 11th lines thereof and substituting therefor the words "an all-terrain vehicle".

Subsec. 17(1) am.

Subsection 17(1) of the Act is amended by striking out the words and figures "Subject to section 4 and to subsection (2)" in the 1st line thereof and substituting therefor the words "Except as may otherwise be required under the Act".

Section 17 of the Act is further amended by adding thereto immediately after subsection (2) thereof the following subsections:

Location of the decals and plate on all-terrain vehicles.

Where a snowmobile is an all-terrain vehicle, the owner shall affix

(a) a permanent snowmobile identification number decal on each rear fender in a secure manner and in a conspicuous position; and

(b) the registration number plate to the rear of the all-terrain vehicle in a secure and conspicuous position.

Location of dealer's plates on all- terrain vehicles.

Where a snowmobile is an all-terrain vehicle, the number plate issued under section 4 shall be affixed to the rear of the all-terrain vehicle in a secure and conspicuous position.

Subsec. 45(2) rep. and sub.

Subsection 45(2) of the Act is repealed and the following subsection is substituted therefor:

Application of provisions of The Highway Traffic Act.

Section 265, subsection 273(2) and section 279 of The Highway Traffic Act apply, mutatis mutandis, to proceedings under this Act.

Subsection 45(3) of the Act is repealed.

Sec. 46 am.

Section 46 of the Act is amended by striking out therefrom the figures and words "234, 236 or subsection 238(3)" and substituting therefor the figures and word "236, 237, 238, 239 or 242".

Sec. 49 am.

Section 49 of the Act is amended

(a) by striking out therefrom the figures and words "(13) of section 6" and substituting therefor the figures "5(15)"; and

(b) by striking out therefrom the words "issued by him" and substituting therefor the words "and validation stickers issued by the authorized person".

Commencement of Act.

This Act comes into force on the day it receives the royal assent.
