Definitions
1 In this regulation,
"fiscal year" means the period of time between April 1 of a year and March 31 of the next year; (« exercice »)
"library collection materials" includes books, periodicals, cassette tapes, videotapes, films, CD-ROMs and access to electronic databases; (« matériel de collection de bibliothèque »)
"operating grant" means a grant made in respect of the expenses connected with the normal operations of a library as approved by the minister, excluding capital expenditure for building, land and the purchase of vehicles; (« subvention de fonctionnement »)
"population" means the population, as set out annually at May 31 of the preceding year by the Minister of Municipal Affairs pursuant to section 3 of The Unconditional Grants Act. (« population »)

Définitions
1 Les définitions qui suivent s'appliquent au présent règlement.

Establishment grant
2(1) Subject to section 7 of The Public Libraries Act, a library may be paid an establishment grant of $5,000 in respect of any municipality that establishes library service pursuant to a by-law passed under section 9, section 22 or subsection 29(4) of The Public Libraries Act and that annually levies and collects a library tax equal to or more than $3.75 per capita, based on the population of the municipality.

2(2) Where a by-law is passed under section 9 of The Public Libraries Act, or a by-law is passed under section 22 and an agreement is thereafter made under section 23 of that Act, or a by-law is passed and an agreement is thereafter made under subsection 29(4) of that Act, the municipal public library or the regional library, as the case may be, to which the by-law passed under section 9 or the agreement made under section 23 or the agreement made under subsection 29(4) relates is eligible for grants under this section on, from and after April 1 next following the date on which the by-law is passed under section 9 or under section 22 or under subsection 29(4) as the case may be.

2(3) The grant to be paid to a public library under subsection (1) shall be made upon the receipt by the minister of
(a) a duly authorized by-law or by-laws following third reading by the municipality or municipalities concerned according to subsection 9(2) or 22(2) or 29(4) of The Public Libraries Act;
(b) a list of the present board members and their addresses; and
(c) in the case of a regional library, a certified copy of an agreement made pursuant to section 23 or subsection 29(4) of The Public Libraries Act.
2(3) La subvention visée au paragraphe (1) est versée à une bibliothèque publique après que le ministre a reçu :

2(4) Each library to which a grant designated as an establishment grant is made under this section shall expend at least four fifths of the amount of that grant in the purchase of library collection materials.

Annual operating grant
3(1) A public library is eligible for an operating grant annually under this section, subject to the following conditions:
(a) that the public library elects to request a grant under this section by completing an application in a form approved by the minister;
(b) that the public library has submitted to the minister an approved budget for the operations of all libraries on or before July 1 in each year in which it is seeking a grant under the section; and
(c) that the public library has submitted to the minister an audited financial statement of actual library revenue and expenditure for the previous year.

3(2) Despite anything in this section, a municipal or regional public library that is established under The Public Libraries Act after the coming into force of this subsection, is not eligible for an operating grant under this section unless the municipality that establishes the municipal public library or each municipality that is a member of a regional public library annually levies and collects a library tax equal to or more than $3.75 per capita, based on the population of the municipality.

3(3) The amount of the grant payable to the public library under this section shall be calculated individually for each municipality that operates a municipal public library or that is a member of a regional public library, on the following basis:
(a) a basic grant, equal to the revenue being raised for library purposes in the current year by the municipality, to a maximum of $8.50 per capita, based on the population of that municipality;
(b) a collection development grant of $5,500. for the purchase of library collection materials for each branch or bookmobile of the public library;
(c) an additional collection development grant of $1,000. for the purchase of library collection materials for each branch or bookmobile of a public library that is located
(i) north of the 53rd parallel, or
(ii) in a designated area as set out in the government's French Language Services Policy.

3(3) Le montant de la subvention versée à la bibliothèque publique en vertu du présent article est calculé pour chaque municipalité qui gère une bibliothèque publique municipale ou qui est membre d'une bibliothèque publique régionale, de la façon suivante :

3(4) A collection development grant under clause (3)(b) or (c) is conditional upon each branch and bookmobile
(a) being open to the public for at least 10 hours per week; and
(b) participating in inter-library loan programs in the Province.

4 For purposes of making an annual operating grant under this regulation, a public library formed under the provisions of The Flin Flon Extension of Boundaries Act, S.M. 1952, chapter 68, as re-enacted by S.M. 1989-90, c. 73, shall be deemed to have the combined population of the Town of Flin Flon and any extended area as may be included under that Act.
4 Aux fins de l'octroi d'une subvention de fonctionnement annuelle en vertu du présent règlement, une bibliothèque publique constituée en vertu de « The Flin Flon Extension of Boundaries Act, S.M. 1952, c. 68 » réadoptée par le c. 73 des L.M. 1989-90, est réputée offrir ses services à la population de la ville de Flin Flon et des territoires qui y sont joints aux termes de cette loi.
5(1) The amount of the grant payable to a municipal public library in The City of Winnipeg shall be 11% of the approved operating budget of the library up to a maximum of $1,910,118.

5(2) A municipal public library in The City of Winnipeg shall, subject to subsection (1) be paid in advance an amount equal to 100% of the entitlement based upon the approved budget of the library or the population, whichever applies, for that fiscal year.
5(2) Les bibliothèques municipales publiques de la Ville de Winnipeg reçoivent à l'avance, sous réserve du paragraphe (1), un montant égal à la totalité de leur subvention, calculé d'après leur budget définitif ou leur bassin de population, selon le cas, pour l'exercice en cause.
5(3) An adjustment of the advance payment made under subsection 5(2) shall be made on receipt of the audited financial statement of the actual operating expenditure covering the year for which the advance payment was made and the adjustment shall be included with the advance payment to be made to the library for the next fiscal year.
5(3) Un ajustement du paiement par anticipation effectué aux termes du paragraphe 5(2) est fait dès la réception de l'état vérifié des dépenses réelles de fonctionnement durant l'exercice visé par le paiement d'anticipation. 5(4) When a grant is made to a municipal public library of The City of Winnipeg, it shall be paid to The City of Winnipeg as the authority responsible for regulating and governing the use of those libraries and maintaining them.
5(4) Toute subvention accordée à une bibliothèque municipale publique de la Ville de Winnipeg est versée à la Ville de Winnipeg qui est chargée de l'administration de ces établissements.
Repeal
6 Manitoba Regulation 215/86 is repealed.
Abrogation
