WHEREAS the Minister of Northern Affairs, for and on behalf of the Community of Wabowden desires, to provide for the naming of highways, the re-naming of highways and the numbering of houses along highways in the Community of Wabowden;

CONSIDÉRANT QUE le ministre des Affaires du Nord, au nom de la communauté de Wabowden, veut prévoir l'attribution de noms aux routes, la modification du nom des routes et l'attribution de numéros aux maisons situées le long des routes dans la communauté de Wabowden.

WHEREAS The Northern Affairs Act, being Chapter N100 of the C.C.S.M. provides in part, as follows:

5(1) . . . The Minister has the powers, rights, privileges and duties that a municipality has within its boundaries and the Minister shall exercise and perform these powers, rights, privileges and duties;

5(5) . . . Where the exercise or performance of the powers, rights, privileges or duties referred to . . . require the passing of a by-law . . . the Minister may make the by-law . . . for or on behalf of the residents of Northern Manitoba, a community or an incorporated community;

« 5(5) [...] lorsque l'exercice des pouvoirs, des droits, des privilèges et des devoirs mentionnés [...] nécessite l'adoption d'un arrêté municipal [...], le ministre peut le faire pour le compte des résidents du Nord, d'une communauté ou d'une communauté constituée ou en leur nom.

5(6) The by-law . . . may be made to apply to the whole or any part of Northern Manitoba.

« 5(6) Les arrêtés municipaux [...] peuvent s'appliquer à tout ou partie du Nord de la province [...]. »;

AND WHEREAS The Municipal Act, being Chapter M225 of the C.C.S.M. provides as follows:

240(1) The council of any municipality may pass by-laws for numbering the lots and houses along the highways of the municipality, and for affixing the numbers of the houses, buildings, or other erections along the highways, and for charging the owner or occupant of each house or lot with the expense incident to the numbering;

« 240(1) Un conseil municipal peut adopter des arrêtés prévoyant le numérotage des lots et maisons bordant les routes de la municipalité, l'affichage des numéros des maisons, bâtiments ou autres constructions bordant les routes et la mise des dépenses occasionnées par ce numérotage à la charge du propriétaire ou de l'occupant de chaque lot ou maison.

241(1) The council of any municipality may pass by-laws for surveying, settling, and marking, the boundary lines of all highways, and for giving names thereto, and affixing the names at the corners thereof, on either public or private property;

« 241(1) Le conseil municipal peut adopter des arrêtés prévoyant l'arpentage des routes, l'établissement et l'indication de leurs limites, les noms qui seront donnés à ces routes et l'installation de plaques portant ces noms aux coins des rues, sur les biens-fonds publics ou sur les biens-fonds privés.

241(2) No by-law for altering the name of a highway has any force or effect unless it has been registered in the land titles district in which the highway is situated.

« 241(2) Un arrêté modifiant le nom d'une route ne peut entrer en vigueur tant qu'il n'a pas été enregistré au district des titres fonciers dans lequel la route est située. »;

AND WHEREAS it is deemed expedient and advisable to name the unnamed highways within the Community of Wabowden;

CONSIDÉRANT QU'il est jugé opportun de donner un nom aux routes de la communauté de Wabowden qui ne portent pas déjà un nom;

AND WHEREAS it is deemed expedient and advisable to re-name certain highways within the Community of Wabowden;

CONSIDÉRANT QU'il est jugé opportun de donner un nouveau nom à certaines routes de la communauté de Wabowden;

AND WHEREAS it is deemed expedient and advisable to affix numbers to buildings within the Community of Wabowden, and said numbers affixed to houses, buildings and other erections along the highway;

CONSIDÉRANT QU'il est jugé opportun d'afficher des numéros aux bâtiments situés dans la communauté de Wabowden et aux maisons, aux bâtiments et aux autres constructions bordant la route;

NOW THEREFORE the Minister of Northern Affairs enacts as follows:

1 This by-law provides in part for the naming of highways established on the basis of the following:

All highways shall be hereafter known by the common names as described below. Subsequent highways created within the Community of Wabowden shall be given and be known by a common name subject to the approval of the Council of the Community of Wabowden.

(i) "Flemming Drive", and being:

Parcel I
Those portions of Road Plans 2102 PLTO (N. DIV.) and 5173 PLTO (N. DIV.) lying southeast of Road Plan 5157 PLTO (N. DIV.),

Parcel II
Those portions of Road Plan 2773 PLTO (N. DIV.) lying northwest of the road on Plan 547 PLTO (N. DIV.) and north of the production westerly of the north limit of Parcel B, Plan 5711 PLTO (N. DIV.),

Parcel III
That portion of the Government Road Allowance between NW ¹/₄ and NE ¹/₄ 30-68-8 WPM which lies between the productions of the most northeasterly and southwesterly limits of Plan 5173 PLTO (N. DIV.),

Parcel IV
That portion of the Government Road Allowance between SW ¹/₄ 28 and SE ¹/₄ 29-68-8 WPM lying between the productions westerly of the north and south limits of the northerly Road Plan 2773 PLTO (N. DIV.) crossing said SW ¹/₄ 28,

(ii) "Lakeside Drive", and being:

That portion of the road in Plan 547 PLTO (N. DIV.) lying north of Railway Plan 535 PLTO (N. DIV.) and between that portion coloured green on Plan 2773 PLTO (N. DIV.) and the production westerly of the north limit of Lot 10, Plan 796 PLTO (N. DIV.),

(iii) "Mulholland Street", and being:

The road in Plan 547 PLTO (N. DIV.) lying north of the production westerly of the north limit of Lot 10, Plan 796 PLTO (N. DIV.),

(iv) "Cran Drive", and being:

Parcel I
Those portions of the Government Road Allowances between NE ¹/₄ 20 and NW ¹/₄ 21; and between SW ¹/₄ 28 and SE ¹/₄ 29, all in 68-8 WPM, lying south of that portion coloured green in Plan 2773 PLTO (N. DIV.),

Parcel II
That portion of road Plan 2773 PLTO (N. DIV.) lying south of Railway Plan 535 PLTO (N. DIV.),

(v) "Doughty Road", and being:

Parcel I
The road in Plan 547 PLTO (N. DIV.) lying south of Lots 18 to 28, Plan 547 PLTO (N. DIV.) and east of S.P. Plan 7225 PLTO (N. DIV.),

Parcel II
That portion of the Government Road Allowance between NW ¹/₄ 21 and SW ¹/₄ 28-68-8 WPM lying west of the production southerly of the east limit of the road in Plan 547 PLTO (N. DIV.) above described in Parcel I,

(vi) "Dram Street", and being:

The road in Plan 547 PLTO (N. DIV.) lying between Lots 24 & 25, Plan 547 PLTO (N. DIV.).

PAR CONSÉQUENT, le ministre édicte ce qui suit :

1 Le présent arrêté prévoit notamment l'attribution de noms aux routes existantes selon les critères suivants :

Les routes existantes porteront désormais le nom indiqué aux descriptions qui suivent. Les routes construites subséquemment dans la communauté de Wabowden porteront un nom approuvé par le conseil communautaire de Wabowden et seront connues sous ce nom.

(i) « Promenade Flemming »

Parcelle I
Les parties des plans routiers n^os 2102 et 5173 du B.T.F.P. (div. N) situés au sud-est du plan routier n° 5157 du B.T.F.P. (div. N),

Parcelle II
Les parties du plan routier n° 2773 B.T.F.P. (div. N) situées au nord-ouest de la route portée au plan n° 547 B.T.F.P. (div. N) et au nord du prolongement vers l'ouest de la limite nord de la parcelle B du plan n° 5711 B.T.F.P. (div. N),

Parcelle III
Le tronçon de l'emprise gouvernementale située entre le ¹/₄ NO de 29-68-8 et le ¹/₄ NE de 30-68-8 O.M.P. se trouvant entre les prolongements de la limite la plus au nord-est et de la limite la plus au sud-ouest du plan n° 5173 B.T.F.P. (div. N),

Parcelle IV
Le tronçon de l'emprise gouvernementale située entre le ¹/₄ SO de 28-68-8 et le ¹/₄ SE de 29-68-8 O.M.P. se trouvant entre les prolongements vers l'ouest des limites nord et sud du nord du plan routier n° 2773 B.T.F.P. (div. N) traversant ledit ¹/₄ SO 28,

(ii) « Promenade Lakeside »

Le tronçon de la route portée au plan n° 547 B.T.F.P. (div. N) situé au nord du plan ferroviaire n° 535 B.T.F.P. (div. N) ainsi qu'entre la partie indiquée en vert au plan n° 2773 B.T.F.P. (div. N) et le prolongement vers l'ouest de la limite nord du lot 10 porté au plan n° 796 B.T.F.P. (div. N),

(iii) « Rue Mulholland »

La route portée au plan n° 547 B.T.F.P. (div. N) située au nord du prolongement vers l'ouest de la limite nord du lot 10 du plan n° 796 B.T.F.P. (div. N),

(iv) « Promenade Cran »

Parcelle I
Les tronçons des emprises gouvernementales situées entre le ¹/₄ NE de 20-68-8 et le ¹/₄ NO de 21-68-8, et entre le ¹/₄ SO de 28-68-8 et le ¹/₄ SE de 29-68-8 O.M.P. se trouvant au sud de la partie indiquée en vert au plan n° 2773 B.T.F.P. (div. N),

Parcelle II La partie du plan routier n° 2773 B.T.F.P. (div. N) situé au sud du plan ferroviaire n° 535 B.T.F.P. (div. N),

(v) « Chemin Doughty »

Parcelle I
La route portée au plan n° 547 B.T.F.P. (div. N) située au sud des lots de 18 à 28 portés au plan n° 547 B.T.F.P. (div. N) et à l'est du plan de lotissement spécial n° 7225 B.T.F.P. (div. N),

Parcelle II
Le tronçon de l'emprise gouvernementale située entre le ¹/₄ NO 21-68-8 et le ¹/₄ SO 28-68-8 O.M.P. se trouvant à l'ouest du prolongement vers le sud de la limite est de la route portée au plan n° 547 B.T.F.P. (div. N) ainsi qu'il est décrit plus haut à la parcelle I,

(vi) « Rue Dram »

La route portée au plan n° 547 B.T.F.P. (div. N) située entre les lots 24 et 25 portés au plan n° 547 B.T.F.P. (div. N).

2 This By-Law provides in part for the re-naming of certain highways which are described as being:

(i) "Smith Street" as same is shown on Plan 853 PLTO (N. DIV.) is hereby changed to and re-named "Mulholland Street", which is to be a continuation of that highway so named in Section 1(iii) above,

(ii) "Moose Road" as same is shown on Plan 853 PLTO (N. DIV.) is hereby changed to and re-named "Tait Road",

(iii) "Sesame Street" as same is shown on Plan 6970 PLTO (N. DIV.) is hereby changed to and re-named "Rock Island Road".

2 Le présent arrêté prévoit notamment la modification du nom de certaines routes qui sont décrites comme suit :

(i) La « rue Smith », portée au plan n° 853 B.T.F.P. (div. N), reçoit, par la présente, le nouveau nom de « rue Mulholland » et constitue le prolongement de la route ainsi nommée à l'alinéa 1(iii) plus haut,

(ii) Le « chemin Moose », porté au plan n° 853 B.T.F.P. (div. N), reçoit, par la présente, le nouveau nom de « chemin Tait »,

(iii) La « rue Sesame », portée au plan n° 6970 B.T.F.P. (div. N), reçoit, par la présente, le nouveau nom de « chemin Rock Island ».

3 This By-law provides in part for a house numbering system to be implemented. The house numbering system shall be implemented on the basis of the following which is shown on Schedule "A" attached hereto:

(i) each street will have a separate sequence of numbers assigned to it,

(ii) the basis for determining the number to be assigned to each house is its proximity to a twenty (20) metre interval which has been plotted down the centerline of each registered street,

(iii) each property fronting on the north or west of a street will be known by the odd number assigned by the twenty (20) metre interval measured on the centerline of the street and immediately in front of the building,

(iv) each property fronting on the south or east of a street will be known by the even number assigned by the twenty (20) metre interval measured on the centerline of the street and immediately in front of the building,

(v) for a building located on a corner lot, the street name and the house number for that building is determined by the location of the front door,

(vi) suites, apartments or offices within a building may be known by the number assigned to the building or the portion of the building in which they are located, prefixed by the unit number or letter and a hyphen,

(vii) the exception to the system used and described above, is the trailer court area. House numbers shall coincide with lot numbers,

(viii) a record of highways and numbers of the houses shall be maintained and available for public inspection,

(ix) authorization is hereby provided to affix a number, once assigned by the responsible authority, to the houses, buildings and erections on said lots on public and private property with the boundaries of the Community of Wabowden.

3 Le présent arrêté prévoit notamment un système de numérotation des maisons devant être mis en place selon les modalités qui suivent ainsi qu'il est indiqué à l'annexe A jointe aux présentes :

(i) Une séquence numérique distincte est attribuée à chaque rue,

(ii) Un numéro est attribué à chaque maison en fonction de la proximité de celle-ci à un des intervalles de vingt (20) mètres qui ont été fixés sur la ligne médiane de chaque rue enregistrée,

(iii) Les biens-fonds bornant le côté nord ou ouest d'une rue se verront attribuer un nombre impair en fonction de l'intervalle de vingt (20) mètres mesuré à la ligne médiane de la rue et situé directement en face du bâtiment,

(iv) Les biens-fonds bornant le côté sud ou est d'une rue se verront attribuer un nombre pair en fonction de l'intervalle de vingt (20) mètres mesuré à la ligne médiane de la rue et situé directement en face du bâtiment,

(v) En ce qui concerne un bâtiment érigé sur un terrain d'angle, le numéro et le nom de rue sont déterminés en fonction de l'emplacement de la porte d'entrée principale,

(vi) Les suites, les appartements et les bureaux d'un bâtiment peuvent être désignés par une lettre ou un chiffre, suivi d'un trait d'union et du numéro attribué au bâtiment ou à la partie de bâtiment dans lequel ils se trouvent,

(vii) Les parcs de maisons mobiles font exception au système décrit plus haut. Dans ce cas, les numéros de maisons correspondent aux numéros des lots,

(viii) Un registre des routes et des numéros de maisons est tenu et le public y a accès pour fins de consultation,

(ix) La présente autorise l'affichage d'un numéro, assigné par l'autorité compétente, sur les maisons, les bâtiments et les constructions érigés sur les biens-fonds publics ou privés situés à l'intérieur de la communauté de Wabowden.

4 This By-law shall come into effect upon filing:

FIRST READING by the Community Council of Wabowden by Resolution No. 88-104.

SECOND READING by the Community Council of Wabowden by Resolution No. 88-105.

THIRD READING by the Community Council of Wabowden by Resolution No. 88-106.

4 Le présent arrêté entre en vigueur le jour de son dépôt.
