Definitions
1 The following definitions apply in this regulation.
"Act" means The Child and Family Services Authorities Act. (« Loi »)
"child and family services" means child and family services under The Child and Family Services Act, The Adoption Act, and the regulations under those Acts. (« services à l'enfant et à la famille »)
"designated agency" means an agency that has been jointly designated by the authorities to provide joint intake and emergency services in accordance with section 21 of the Act to all persons in a specified geographic region of the province. (« office désigné »)
"intake and emergency services" means child and family services that are provided to persons
(a) when services are first requested or required; or
(b) when services are required on an emergency basis for the protection of a child. (« services d'accueil et d'urgence »)
"mandating authority" means, in relation to an agency, the authority that has mandated, or is deemed to have mandated, that agency in accordance with Part I of The Child and Family Services Act. (« régie d'autorisation »)
"record" means a record of information in any form, and includes information that is written, photographed, recorded or stored in any manner, on any storage medium or by any means, including by graphic, electronic or mechanical means, but does not include electronic software or a mechanism that produces records. (« document »)
"service record" means a record in the custody or under the control of a designated agency that relates to providing intake and emergency services to a person or family. (« document interne »)

Designation of designated agencies
2 The agencies listed in the Schedule have been jointly designated by the Northern Authority, the Southern Authority, the Metis Authority and the General Authority under subsection 21(1) of the Act to provide joint intake and emergency services within the geographic regions of the province described in the Schedule.

Role of the mandating authority
3 Although the authorities jointly designate an agency as a designated agency,
(a) the mandating authority of the agency has the duties and powers of an authority in relation to that agency; and
(b) the agency is under the direction of its mandating authority.

Duties and powers of designated agencies
4 In providing intake and emergency services, a designated agency
(a) has the duties and powers of a child and family services agency as set out in The Child and Family Services Act, The Adoption Act and the regulations under those Acts;
(b) must carry out the policies set out in the annual operating plan for the designated agency prepared by the authorities under subsection 11(1); and
(c) must provide those services in accordance with standards established by the director.

Providing services
5 A designated agency must
(a) provide intake and emergency services for 24 hours each day; and
(b) respond to all referrals or requests for services on a timely basis.

Advertising central phone number
6 A designated agency must widely advertise a central telephone number within the geographic region where it provides intake and emergency services and must
(a) list the telephone number in the appropriate telephone directories;
(b) notify law enforcement agencies, schools and hospitals that are in the region as to the number; and
(c) otherwise advertise the number as the authorities or the director may require.

If another agency already providing services
7 If, in the course of providing child and family services, a designated agency determines that
(a) a person or family is currently receiving services from another agency; or
(b) a child is currently in the care of another agency;
it must notify the other agency and, with that agency, develop a plan for providing services to the person or family.

Providing child protection services
8 With respect to child protection under Part III of The Child and Family Services Act, a designated agency must, in particular, do the following:
(a) determine whether a child is or might be in need of protection and, if so, take appropriate action to ensure the protection of the child;
(b) investigate reports that a child is or might be in need of protection, including investigating allegations of abuse of a child;
(c) apprehend a child in need of protection and take the child to, or leave the child in, a place of safety;
(d) provide crisis stabilization services to ensure the safety and well-being of a child;
(e) take the actions that an agency must take as set out in the Child Abuse Regulation, if it suspects that a child is or might be abused, including referring the matter to the child abuse committee of an appropriate agency operating within the geographic region of the designated agency, as determined by the authorities;
(f) commence court proceedings as may be required under The Child and Family Services Act.

Assessing need for ongoing services
9(1) After providing intake and emergency services to a person or family, a designated agency must determine if child and family services are required on an ongoing basis.

Transfer to appropriate agency
9(2) If services are required on an ongoing basis, the designated agency must
(a) determine the authority of service that is responsible for providing ongoing services to the person or family in accordance with the authority determination protocol established in Part 2 of the Child and Family Services Authorities Regulation;
(b) arrange to transfer responsibility for the person or family to the appropriate agency (the "receiving agency") in accordance with the authority determination protocol; and
(c) forward the person's or family's service records to the receiving agency that will be providing ongoing services.

Confirmation of transfer required
9(3) The designated agency must not transfer responsibility for the person or family to the receiving agency for ongoing services until it receives written confirmation from the receiving agency that it assumes responsibility for the person or family.

Managing records
10 A designated agency has the same duties and powers that an agency has under The Child and Family Services Act, The Adoption Act and the regulations under those Acts with respect to managing records and allowing access to and disclosure of information from the records.

Annual operating plan required
11(1) The authorities must, jointly with each other and in consultation with the proposed designated agency, prepare and submit to the director for approval, an annual operating plan describing how each designated agency will provide intake and emergency services.

First annual operating plan
11(2) The first annual operating plan must cover the period beginning on the first day the designated agency provides services, and ending on March 31. But if that period is not more than six months, the plan must cover the period ending on the second March 31 after it begins.

11(3) Subsequent annual operating plans must cover the period from April 1 of one year to March 31 of the next, and must be submitted to the director on or before September 1 of the year before the period begins.

Changes to annual operating plan
11(4) The authorities must submit proposed changes to the annual operating plan to the director for approval, at least two months before the date the changes are to come into effect.

Content of annual operating plans
11(5) An annual operating plan for a designated agency must include the following information:
(a) the agency's name and the geographic region for which it is the designated agency;
(b) the location of agency offices in the region that will provide joint intake and emergency services;
(c) the central telephone number for the designated agency and the steps the designated agency has taken or will take to ensure that the central telephone number is widely advertised;
(d) if the authorities have established a joint management board for the designated agency, the policies of that board with respect to providing joint intake and emergency services;
(e) a list of child abuse committees operating within the geographic region of the designated agency;
(f) a detailed description as to how the agency will provide intake and emergency services for 24 hours each day, including information as to the management and staffing of each agency office;
(g) a list of services available in the region for dealing with emergencies;
(h) a list of community service providers with a description of the alternative services they are able to provide and information as to the agency's relationship with them;
(i) such other information as the director may require.

Coming into force
12 This regulation comes into force on the day The Child and Family Services Authorities Act, S.M. 2002, c. 35, comes into force.
