"expanded municipality" means the Rural Municipality of Shell River, with its boundaries expanded as provided in section 2. (« municipalité étendue »)

"Park North" means the following portion of the Rural Municipality of Park:

Townships 29 and 30 – 28 WPM; Township 29 – 29A and 29 WPM; and Sections 1 and 12, and Frac Sections 2 and 11 in Township 30 – 29A WPM. (« Park North »)

Annexation of Park North

2(1) Park North is annexed by the Rural Municipality of Shell River.

2(2) The boundaries of the Rural Municipality of Shell River are as set out in the Municipal Status and Boundaries Regulation, Manitoba Regulation 567/88 R, as amended by the Municipal Status and Boundaries Regulation, amendment (Shell River — Park North).

Composition of the council of the expanded municipality

3(1) The council of the expanded municipality is composed of the head of council and six councillors.

3(2) On the coming into force of this section,

(a) the size of the council of the expanded municipality is increased to six councillors, with each councillor representing a ward;

(b) the number of wards of the expanded municipality is increased to six, with the wards having the following ward boundaries:

Ward 1: Township 25 – 28 and 29 WPM;

Ward 2: Township 26 – 28 WPM; and Sections 1 to 25 and 36 in Township 26 – 29 WPM;

Ward 3: Townships 27 and 28 – 28 and 29A WPM;

Ward 4: Township 27 and 28 – 29 WPM; and Sections 26 to 35 in Township 26 – 29 WPM;

Ward 5: Townships 29 and 30 – 28 WPM;

Ward 6: Township 29 – 29A and 29 WPM; and Sections 1 and 12 and Frac Sections 2 and 11 in Township 30 – 29A WPM;

(d) the councillor for Ward 1 of the Rural Municipality of Park

(i) ceases to be a councillor of the Rural Municipality of Park, and

(ii) becomes the councillor of Ward 6 of the expanded municipality; and

(e) the councillor for Ward 2 of the Rural Municipality of Park

(i) ceases to be a councillor of the Rural Municipality of Park, and

(ii) becomes the councillor of Ward 5 of the expanded municipality.

3(2) Au moment de l'entrée en vigueur du présent article :

a) le nombre de conseillers de la municipalité étendue est porté à six, chaque conseiller représentant un quartier;

Ward boundaries of the expanded municipality

4 The council of the expanded municipality may, in accordance with Division 2 (Elections) of Part 3 of The Municipal Act, alter or repeal the ward boundaries established under section 3.

Application

5 Subject to the provisions of sections 6 to 10, the Act applies to the 2006 general election in the Rural Municipality of Park and the Rural Municipality of Shell River.

Head of council

6(1) A person who is an eligible voter in Park North is

(a) an eligible voter in the election of the head of council for the Rural Municipality of Shell River, but is not an eligible voter in the election of the head of council for the Rural Municipality of Park; and

(b) eligible to be nominated for the office of head of council for the Rural Municipality of Shell River, but is not eligible to be nominated for the head of council for the Rural Municipality of Park.

6(2) A person must be eligible to vote in the election for the head of council in order to be eligible to sign the nomination papers of a candidate in that election.

Councillors

7 A person must be an eligible voter in Park North in order to

(a) be nominated in Wards 1 or 2 of the Rural Municipality of Park; or

(b) sign the nomination papers of a candidate in the election of councillor in those Wards.

Rights of candidate for head of council

8 A candidate for head of council in the Rural Municipality of Shell River has all the rights and obligations of a candidate for council in Park North under the Act, including without limitation,

(a) the right to receive, on request, a copy of the voters list for Park North;

(b) the right to canvass or distribute election material at the entrance door of each residence in an apartment, condominium complex or other multiple-unit residence in Park North;

(d) the right to attend the tallying of the vote; and

(e) the obligation to uphold the rights of voters under section 65 of the Act and preserve the secrecy of the vote in accordance with section 87 of the Act.

Senior election official: RM of Park

9(1) The senior election official of the Rural Municipality of Park must

(a) prepare and maintain a separate voters list for Wards 1 and 2 of the Rural Municipality of Park;

(b) include the eligibility requirements of sections 6 and 7 in the public notice of nominations and the public notice of election, as required under sections 41 and 48 of the Act;

(c) ensure that ballots cast by voters in Wards 1 and 2, including advance, mobile and sealed envelope ballots, are not placed in any ballot boxes that contain ballots cast by residents of Wards 3 to 6; and

(d) in respect of the votes cast in Wards 1 and 2 for head of council, forward the preliminary results and the final tally of the votes to the senior election official of the Rural Municipality of Shell River as soon as reasonably possible;

(e) in the event of a recount for the office of head of council of the Rural Municipality of Shell River, attend the recount and bring the ballot boxes containing the votes cast in Wards 1 and 2 for head of council and any other required documents.

9(1) Le fonctionnaire électoral principal de la municipalité rurale de Park :

a) tient à jour une liste électorale distincte pour les quartiers 1 et 2 de cette municipalité;

9(2) The senior election official of the Rural Municipality of Park must not

(a) establish a voting place in or on any premises in which a candidate for head of council of the Rural Municipality of Shell River has any estate or interest; or

(b) under section 114 of the Act, combine ballots cast by voters in Wards 1 and 2, including advance, mobile and sealed envelope ballots, into a ballot box that contains ballots cast by residents of Wards 3 to 6.

9(2) Le fonctionnaire électoral principal de la municipalité rurale de Park ne peut :

Senior election official: RM of Shell River

10 The senior election official of the Rural Municipality of Shell River must ensure that

(a) a separate ballot is used for the election of the office of head of council; and

(b) the senior election official of the Rural Municipality of Park is provided with enough of those ballots to enable residents of Wards 1 and 2 of the Rural Municipality of Park to vote for the office of head of council for the Rural Municipality of Shell River.

10 Le fonctionnaire électoral principal de la municipalité rurale de Shell River fait en sorte :

a) qu'un bulletin de vote distinct soit utilisé pour l'élection du président du conseil;

b) que son homologue de la municipalité rurale de Park reçoive un nombre suffisant de ces bulletins de vote pour permettre aux résidents des quartiers 1 et 2 de cette municipalité rurale de voter pour un candidat au poste de président du conseil de la municipalité rurale de Shell River.

Coming into force

11(1) This regulation, except sections 2, 3 and 4, comes into force on the day it is registered under The Regulations Act.

11(1) Le présent règlement, à l'exception des articles 2 à 4, entre en vigueur à la date de son enregistrement sous le régime de la Loi sur les textes réglementaires.

11(2) Sections 2, 3 and 4 come into force on January 1, 2007.
