Corrections and minor changes made under the authority of section 25 of The Statutes and Regulations Act

General information about corrections and minor changes

The Statutes and Regulations Act requires Manitoba legislation to be published on the Manitoba Laws website. Under subsection 25(1) of the Act, the chief legislative counsel is required to correct consolidation and publication errors. Under subsection 25(2) of the Act, the chief legislative counsel may make minor corrections or changes to the consolidated version of an Act or regulation without changing its legal effect.

Notice of the following types of minor changes must be given:

replacing a description of a date or time with the actual date or time; [s. 25(2)(f)]
replacing a reference to a bill or any part of a bill with a reference to the resulting Act or part of the Act after the bill is enacted and assigned a chapter number; [s. 25(2)(g)]
removing a reference to a contingency in a provision that is stated to come into effect when or if that contingency occurs, if that contingency has occurred, or is required as a result of removing such a reference; [s. 25(2)(h)]
updating a reference to a person, office, organization, place or thing if an Act provides that references to it are deemed or considered to be references to another person, office, organization, place or thing; [s. 25(2)(i)]
updating a reference to reflect a change in the name, title, location or address of a person, office, organization, place or thing, other than
- a change in the name or title of a document adopted or incorporated by reference unless it was adopted or incorporated as amended from time to time, and
- a change in the title of a minister or the name of a department; [s. 25(2)(j)]
updating a reference to a minister or department when, under subsection 5(3) of The Executive Government Organization Act, the Act is to be read as if it were amended as necessary to give effect to an order in council made under that Act; [s. 25(2)(k)]
correcting an error in the numbering of a provision or other portion of an Act, or making a change to a cross-reference required as a result of such a correction; [s. 25(2)(l)]
correcting an obvious error in a cross-reference, if it is obvious what the correction should be; [s. 25(2)(m)]
if a provision of a transitional nature is contained in an amending Act, incorporating it as a provision of the consolidated Act and make any other changes that are required as a result; [s. 25(2)(n)]
removing a provision that is deemed by The Interpretation Act to have been repealed because it has expired, lapsed or otherwise ceased to have effect. [s. 25(2)(o)]

Definitions

1 In this regulation,

"Act" means The Wildlife Act; (« Loi »)

"director" means the Director of the Wildlife and Ecosystem Protection Branch, Department of Conservation; (« directeur »)

"hunt" means hunt, take, kill, retrieve or possess; (« chasser »)

"running at large" means an animal that has been released or has escaped confinement and is roaming at will. (« en liberté »)

Restricted exotic wildlife

3(1) Except as provided in this section, no person shall

(a) import into the province;

(b) possess or harbour; or

a live animal listed in Schedule B.

Possession with permit

3(2) A person may possess or harbour a live animal listed in Schedule B if the person is permitted to do so by

(a) a permit issued by the minister under this regulation; or

(b) a licence issued under The Livestock Industry Diversification Act.

Exception for research and zoos

3(3) The minister may issue a permit to import a live animal listed in Schedule B to a public facility established for the purposes of research, public education or zoological display. The permit may be issued subject to any terms and conditions that the minister considers necessary or advisable.

Exception for immediate slaughter

3(3.1) The minister may issue a permit authorizing a person to import a live animal listed in Schedule B in order to have the animal slaughtered at a facility licensed under the Meat Inspection Act (Canada). The permit may be issued subject to any terms and conditions that the minister considers necessary or advisable.

Permanent identification

3(4) An animal listed in Schedule B must be permanently numbered by the owner with a unique identifier that can be traced back to the owner of the animal. The numbering must be done using an implant, a brand, a tattoo or other means of permanent numbering approved by the director. Numbering of a wild boar may be done using a nose ring.

3(5) The holder of a permit to possess an animal listed in Schedule B must submit annually, a record of

(a) the identification type, location and unique identifier for every animal he or she possesses;

(b) information on every animal added or deleted during the period covered by the report, including the origin of a new animal and the reason for deleting an animal; and

(c) if required under the Wildlife Protection Regulation, M.R. 85/2003, the date an animal was last tested for a disease set out in Schedule A to that regulation and the result of the test.

Controlled exotic wildlife

3.1(1) Except as provided in this section, no person shall

(a) import into the province;

(b) possess or harbour; or

a live animal listed in Schedule C.

Possession with permit

(b) the animal is prescribed in a regulation under The Animal Liability Act as livestock and is possessed for agricultural purposes.

Hunting exotic wildlife running at large

4(1) For the purpose of public safety or the protection of wildlife, wildlife habitat or public or private property, an officer or a person authorized to enforce a municipal by-law may hunt, trap or capture exotic wildlife running at large.

4(2) A person may, for the purpose of defending or preserving his or her property, hunt, trap or capture any exotic wildlife running at large on the person's own land.

Interference with control program

5 No person shall interfere with

(a) a trap, capture device or holding facility set by an officer, an employee, agent or co-operator of the Department of Conservation, or a person enforcing a municipal by-law for the purpose of hunting, trapping or capturing exotic wildlife; or

(b) an employee, agent or co-operator of the Department of Conservation, who is engaged in any activity associated with hunting, trapping or capturing exotic wildlife.

6 The owner or keeper of exotic wildlife that has escaped confinement must

(a) immediately report the escape to the nearest office of the Department of Conservation;

(b) immediately make reasonable attempts to capture or kill the escaped animal; and

Exotic wildlife control areas

7(1) In order to eliminate or control exotic wildlife running at large, the director may designate an area of the province to be an exotic wildlife control area for one or more species of exotic wildlife specified by the director in the designation.

Notice of exotic wildlife control areas

7(2) The director shall give notice of an exotic wildlife control area by at least one of the following methods:

(a) publishing a notice in a local newspaper;

(b) posting signs in or near the area.

Hunting restricted to residents

8(1) No person shall hunt a species of exotic wildlife running at large in an exotic wildlife control area unless the person is a Manitoba resident and is hunting in an area designated as an exotic wildlife control area for that species and the person

(a) resides or owns land in that exotic wildlife control area; or

(b) is hunting in a municipality that

(i) has issued written authorization to the person allowing him or her to hunt that species of exotic wildlife, or

(ii) has published notice dispensing with the requirement for written authorization to hunt that species of exotic wildlife.

Exemptions

8(2) A person hunting exotic wildlife under subsection (1) is exempted from complying with the Vehicle Use in Hunting Regulation, Manitoba Regulation 212/94, and any provisions of the Act and regulations made under the Act respecting the following matters:

(a) hunting licences or permits;

(b) possession or transportation permits;

(d) restrictions that limit hunting to a specific day of the week;

(e) bag limits or a possession limits;

(f) restrictions that limit the capacity of a shotgun to three shells in the chamber and magazine combined;

(g) hunter orange head and upper body coverings except when a big game season is open in the area where the hunting is taking place, if hunters are required to wear hunter orange in that big game season.

g) le port d'une casquette et d'une pièce d'étoffe de couleur orange chasseur, sauf lorsqu'elles sont tenues de porter cette couleur au cours d'une saison de chasse au gros gibier dans une zone donnée.
