WHEREAS The Northern Affairs Act, C.C.S.M. c. N100, provides in part as follows:

5(1)   ... the minister has the powers, rights, privileges and duties that a municipality has within its boundaries and the minister shall exercise and perform these powers, rights, privileges and duties.

ATTENDU QUE la Loi sur les Affaires du Nord, c. N100 de la C.P.L.M., prévoit notamment ce qui suit :

« 5(1) [...] le ministre exerce [...] les pouvoirs, les droits, les privilèges et les devoirs que possède une municipalité à l'intérieur de ses limites.

5(5)   ... where the exercise or performance of the powers, rights, privileges or duties referred to in those subsections require the passing of a by-law, or the making of a resolution, the minister may make the by-law or the resolution for or on behalf of the residents of Northern Manitoba, a community or an incorporated community.

« 5(5) [...] lorsque l'exercice des pouvoirs, des droits, des privilèges et des devoirs mentionnés dans ces paragraphes nécessite l'adoption d'un arrêté municipal ou d'une résolution, le ministre peut le faire pour le compte des résidents du Nord, d'une communauté ou d'une communauté constituée ou en leur nom.

5(6)   The by-law or resolution may be made to apply to the whole or any part of Northern Manitoba....

« 5(6) Les arrêtés municipaux ou les résolutions peuvent s'appliquer à tout ou partie du Nord [...]. »;

AND WHEREAS The Municipal Act, C.C.S.M. c. M225, provides in part as follows:

ATTENDU QUE la Loi sur les municipalités, c. M225 de la C.P.L.M., prévoit notamment ce qui suit :

176(1)   Every municipality shall by by-law establish or participate in a plan or scheme to provide pensions or superannuation allowances for its full time employees and its part time employees....

« 176(1) Chaque municipalité doit, par arrêté, établir un régime de pension ou de rentes de retraite, ou y participer, pour ses employés à plein temps et ses employés à temps partiel [...].

176(2)   A plan mentioned in subsection (1), which a municipality establishes or in which it participates may, in addition to pensions or superannuation allowances, provide other benefits for employees or their surviving dependants including, without limiting the generality of the foregoing, insurance on the lives of employees or their dependents or both, disability allowances, surviving dependents allowances and surviving spouse allowances.

« 176(2) Un régime qu'une municipalité établit ou auquel elle participe aux termes du paragraphe (1) peut offrir, en plus des pensions ou des rentes de retraite, d'autres avantages aux employés et aux personnes à leur charge qui leur survivent, notamment, sans limiter la portée générale de ce qui précède, une assurance sur la vie des employés ou des personnes à leur charge, des prestations d'invalidité et des prestations payables aux personnes à charge et aux conjoints survivants. »;

AND WHEREAS some communities, by by-law enacted with the consent of the Minister under subsection 5(7) of The Northern Affairs Act, are members of the Municipal Employees Benefits Program, and other communities are applying to become members of it;

ATTENDU QUE certaines communautés participent, aux termes d'un règlement adopté du consentement du ministre et en vertu du paragraphe 5(7) de la Loi sur les Affaires du Nord, au Programme des avantages sociaux des employés municipaux et que d'autres communautés ont présenté une demande de participation;

NOW THEREFORE the Minister enacts, for and on behalf of the community councils, community committees and incorporated community councils that are established under The Northern Affairs Act and that have not by their own by-law become members of the Municipal Employees Benefits Program, as follows:

PAR CONSÉQUENT, le ministre, agissant au nom des conseils communautaires, des comités locaux et des conseils de communautés constituées créés aux termes de la Loi sur les Affaires du Nord qui n'ont pas adopté un règlement leur permettant de participer au Programme des avantages sociaux des employés municipaux, édicte ce qui suit :

Definitions

1   In this by-law,

"board" means The Municipal Employees Benefits Board established under The Municipal Act; (« Commission »)

"council" means a community council or local committee established by the minister under The Northern Affairs Act, or the council of an incorporated community; (« conseil »)

"department" means the Administration Division of the Department of Northern Affairs in Thompson, Manitoba; (« ministère »)

"employee" means an employee of a council; (« employé »)

"municipal pension plan" means the Pension Plan provided through the board; (« régime de pension municipal »)

"plan" means a pension plan, a group life insurance plan, or a disability pension plan that is part of the program; (« régime »)

"program" means the Municipal Employees Benefits Program; (« programme »)

"Canada Pension Plan earnings" means the level of earnings established under the Canada Pension Plan as pensionable earnings for a calendar year. (« salaire cotisable au RPC »)

Définitions

1   Les définitions qui suivent s'appliquent au présent arrêté.

« Commission » La Commission des avantages sociaux des employés municipaux créée aux termes de la Loi sur les municipalités. ("board")

« conseil » Conseil communautaire ou comité local que créé le ministre en vertu de la Loi sur les Affaires du Nord ou le conseil d'une communauté constituée. ("council")

« employé » Tout employé d'un conseil. ("employee")

« ministère » La Direction de l'administration du ministère des Affaires du Nord située à Thompson, au Manitoba. ("department")

« programme » Programme des avantages sociaux des employés municipaux. ("program")

« régime » Régime de pension, régime collectif d'assurance sur la vie ou régime de rentes d'invalidité qui fait partie du programme. ("plan")

« régime de pension municipal » Régime de pension fournit par l'intermédiaire de la Commission. ("municipal pension plan")

« salaire cotisable au RPC » Fraction d'un salaire soumise aux cotisations du Régime de pensions du Canada au cours d'une année civile. ("Canada Pension Plan earnings")

Eligibility requirements

2   An employee is eligible to participate in the program where the employee complies with any condition established by the board and with the requirements of the program, including the following:

(a) in the case of the pension plan, the employee

(i) where participation is not mandatory, submits an application,

ii) is under the age of 71,

iii) completes any probationary period required by the council, and

iv) is employed full time, or earns more than 1/4 of the Canada Pension Plan earnings for two consecutive years immediately before the date on which the employee is otherwise eligible or April 1, 1990, whichever is later;

(b) in the case of the group life insurance plan, the employee

i) is a member of the pension plan, and

ii) submits an application for membership in the plan and a statement of good health that is satisfactory to the board;

(c) in the case of the disability pension plan, the employee

i) is under the age of 65,

ii) is a member of the pension plan, and

iii) submits an application for membership in the plan and a statement of good health that is satisfactory to the board.

Admissibilité

2   Sont admissibles au programme les employés qui se conforment aux conditions du programme, aux exigences fixées par la Commission ainsi qu'aux conditions suivantes :

a) pour le régime de pension, l'employé :

i) présente une demande si la participation au régime n'est pas obligatoire,

ii) n'a pas atteint l'âge de 71 ans,

iii) termine une période d'essai exigée par le conseil,

iv) travaille à temps plein ou gagne plus du ¼ du salaire cotisable au RPC pendant les deux années consécutives précédant sa date d'admissibilité ou le 1er avril 1990, si cette date est postérieure;

b) pour le régime collectif d'assurance sur la vie, l'employé :

i) participe au régime de pension,

ii) présente une demande de participation au régime ainsi qu'une déclaration, exigée par la Commission, attestant de sa bonne santé;

c) pour le régime de rentes d'invalidité, l'employé :

i) n'a pas atteint 65 ans,

ii) participe au régime de pension,

iii) présente une demande de participation au régime ainsi qu'une déclaration, exigée par la Commission, attestant de sa bonne santé.

Councils to participate in pension plan

3   A council shall participate in the pension plan as of April 1, 1990 and shall

(a) deduct, from the earnings of an employee who participates in the pension plan, the contributions required to be made by the employee to it; and

(b) remit the contributions, with the amounts required to be paid by the council, to the department;

and the department shall remit the contributions to the board on or before the applicable remittance date and shall execute such documents as are necessary to implement this by-law.

Participation du conseil

3   Les conseils participent au régime de pension à partir du 1er avril 1990 et :

a) retiennent, sur les gains des employés qui participent au régime de pension, les cotisations que doivent verser ceux-ci;

b) versent au ministère les cotisations ainsi que les montants qu'ils doivent contribuer.

Le ministère remet les contributions à la Commission au plus tard à la date de versement prévue et passe les documents nécessaires à l'application du présent arrêté.

New employee's participation is mandatory

4   A person who becomes an employee of a council after March 31, 1990 and who is eligible to participate in the pension plan shall, as a condition of employment, be a member of the pension plan.

Participation obligatoires des nouveaux employés

4   Toute personne qui entre au service d'un conseil après le 31 mars 1990 est tenue de participer au régime de pension si elle remplit les conditions d'admissibilité.

Where employee may choose to participate

5   A person who is an employee of a council on March 31, 1990 and who is eligible to participate in the pension plan shall as a condition of employment become a member of the plan on April 1, 1990 unless before that date the person advises the clerk of the council in writing that he or she does not wish to participate in the pension plan.

Participation facultative

5   Les employés d'un conseil qui sont admissibles, au 31 mars 1990, au régime de pension sont tenus d'y participer à partir du 1er avril 1990 à moins qu'ils n'aient avisé par écrit le greffier du conseil avant cette date de leur intention de ne pas y participer.

6   A council shall participate in the group insurance plan as of April 1, 1990 and shall

(a) deduct, from the earnings of an employee who participates in the plan, the contributions required to be made by the employee to it; and

(b) remit the contributions, with the amounts required to be paid by the council, to the department;

and the department shall remit the contributions to the board on or before the applicable remittance date and shall execute such documents as are necessary to implement this by-law.

9   A council shall participate in the disability pension plan from April 1, 1990 and shall

(a) deduct the contributions required from the earnings of an employee who participates in the plan; and

(b) remit the contributions, with the required contribution of the council, to the department;

and the department shall remit the contributions to the board and shall execute such documents and carry out such things as are necessary to implement this by-law.

9   Les conseils participent au régime de rentes d'invalidité à partir du 1er avril 1990 et :

a) retiennent les cotisations nécessaires sur les gains des employés qui participent au régime;

b) versent au ministère les cotisations ainsi que les montants qu'ils doivent contribuer.

Le ministère remet les contributions à la Commission et passe les documents et prend les mesures nécessaires à l'application du présent arrêté.

New employee's participation is mandatory

10   A person who is employed by a council on or after the effective date of the disability pension plan shall participate in the plan on and from the first day of the pay period after the person is eligible to participate.

10   Les personnes qui entrent au service d'un conseil après la date d'entrée en vigueur du régime de rentes d'invalidité sont tenues d'y participer à partir du premier jour de la période de paie suivant la date à laquelle elles deviennent admissibles.

Employee may decline membership

11   A person who is an employee of a council on April 1, 1990 shall participate in the disability pension plan when he or she becomes eligible to participate in it, unless the person provides the board with a notice in writing before the eligibility date that he or she does not wish to participate.

Participation facultative

11   Les personnes qui sont au service d'un conseil le 1er avril 1990 sont tenues de participer au régime de rentes d'invalidité dès la date à laquelle elles y deviennent admissibles à moins qu'elles n'aient avisé la Commission par écrit avant cette date de leur intention de ne pas y participer.
