Definitions

1   The following definitions apply in this regulation.

"Act" means The Animal Diseases Act. (« Loi »)

"diagnostic material" means a part of a live animal or carcass or a biological sample from a live animal or carcass that, when analyzed or tested, may provide information that is relevant to determining whether the animal has suffered from, or is or has been infected with, a reportable disease. (« matériel diagnostique »)

1   Les définitions qui suivent s'appliquent au présent règlement.

« Loi » La Loi sur les maladies des animaux. ("Act")

« matériel diagnostique » Partie ou prélèvement biologique d'un animal vivant ou d'une carcasse dont l'analyse ou l'examen peut fournir des renseignements permettant de déterminer si un animal est ou a été atteint d'une maladie déclarable ou s'il a été infecté par une telle maladie. ("diagnostic material")

Reportable diseases designated

2   The following diseases are designated as reportable diseases for the purposes of the Act:

(a) all diseases that are prescribed as reportable diseases in regulations made under subsection 2(2) of the Health of Animals Act (Canada);

(b) all diseases listed in Schedule VII (Immediately Notifiable Diseases) to the Health of Animals Regulations, C.R.C., c. 296, made under the Health of Animals Act (Canada);

(c) Coxiella burnetii (Q Fever);

(d) ovine chlamydiosis (enzootic abortion of ewes);

(e) Mycobacterium paratuberculosis;

(f) Salmonella choleraesuis;

(g) Salmonella abortus equi;

(h) Salmonella enteritidis;

(i) Salmonella typhimurium (multi-drug resistant isolates);

(j) American foulbrood (Paenibacillus larvae subsp. Larvae);

(k) European foulbrood (Melissococcus pluton);

(l) nosema (Nosema apis);

(m) acarine (Acarapis woodi);

(n) Francisella tularensis (tularemia);

(o) influenza A;

(p) transmissible gastroenteritis in swine (TGE coronavirus);

(q) porcine epidemic diarrhea.

Maladies déclarables

2   Les maladies énumérées ci-après sont désignées à titre de maladies déclarables pour l'application de la Loi :

a) les maladies qui sont désignées maladies déclarables par les règlements pris en vertu du paragraphe 2(2) de la Loi sur la santé des animaux (Canada);

b) les maladies indiquées à l'annexe VII du Règlement sur la santé des animaux, C.R.C., ch. 296 pris sous le régime de la Loi sur la santé des animaux (Canada);

c) Coxiella burnetti (fièvre Q);

d) chlamydiose ovine (avortement enzootique des brebis);

e) Mycobacterium paratuberculosis;

f) Salmonella choleraesuis;

g) Salmonella abortus equi;

h) Salmonella enteritidis;

i) Salmonella typhimurium (isolats multirésistants);

j) loque américaine (Paenibacillus larvae subsp. larvae);

k) loque européenne (Melissococcus pluton);

l) nosémose (Nosema apis);

m) acariose (Acarapis woodi);

n) Francisella tularensis (tularémie);

o) grippe A;

p) gastro-entérite transmissible du porc (coronavirus responsable de la GET);

q) diarrhée épidémique porcine.

Protection of diagnostic material

3(1)   A person who suspects that an animal has a reportable disease or that an animal died while infected with a reportable disease must

(a) ensure that the animal or any part of its carcass that may be a source of diagnostic material is protected from deterioration;

(b) ensure that all reasonable steps are taken to collect and store the diagnostic material in a way so as to preserve its integrity and diagnostic value; and

(c) give the diagnostic material to an inspector, or to another person authorized by the director to receive it for diagnostic testing.

3(1)   La personne qui soupçonne qu'un animal est atteint d'une maladie déclarable ou qu'il était infecté par une telle maladie à sa mort :

a) s'assure que l'animal ou toute partie de sa carcasse pouvant servir de matériel diagnostique est à l'abri de la détérioration;

b) s'assure que toutes les mesures raisonnables sont prises dans la collecte et l'entreposage du matériel diagnostique de manière à préserver son intégrité et sa valeur diagnostique;

c) rend le matériel diagnostique à un inspecteur ou à la personne qu'il autorise afin que des tests de diagnostic soient effectués.

3(2)   No person shall destroy diagnostic material if the material may be used to diagnose a reportable disease.

3(2)   Il est interdit de détruire du matériel diagnostique pouvant servir à diagnostiquer une maladie déclarable.

Veterinary examination of symptomatic animals

4(1)   A person who has care and control of an animal that displays clinical signs compatible with a reportable disease must have the animal clinically examined by a veterinarian without delay after becoming aware that a reportable disease may be indicated.

4(1)   La personne qui a en sa possession ou à sa charge un animal présentant des signes cliniques correspondant à une maladie déclarable lui fait subir sans délai un examen clinique effectué par un vétérinaire dès qu'elle prend connaissance de l'existence possible d'une maladie déclarable.

4(2)   The director or a person authorized by him or her may, out of money appropriated for this purpose under an Act of the Legislature, approve payment to the examining veterinarian of part or all of the veterinarian's reasonable charges for the clinical examination, including, but not limited to, professional fees and sampling and diagnostic testing charges.

4(2)   Le directeur ou la personne qu'il autorise peut, à même l'argent attribué à cet égard en vertu d'une loi de la Législature, accorder le paiement au vétérinaire d'une partie ou de l'ensemble de ses frais raisonnables pour l'examen clinique, notamment les droits professionnels ainsi que les frais de prélèvement et de tests diagnostiques.
