Definitions

1 The following definitions apply in this regulation.

"Act" means The Water Resources Administration Act. (« Loi »)

"artificial flooding" means artificial flooding of the Assiniboine River caused by the operation of the Shellmouth Dam. (« inondation artificielle »)

"artificial flooding report" means a report made under subsection 12.7(1) of the Act setting out the extent and duration of artificial flooding caused by the operation of the Shellmouth Dam, and including the other information required by subsection 3(1). (« rapport concernant une inondation artificielle »)

Shellmouth Dam lands and structures

2 For the purposes of the definition "Shellmouth Dam" in section 1 of the Act, the following lands and structures comprise the Shellmouth Dam:

(a) the dam on the Assiniboine River known as the "Shellmouth Dam", located at sections 1, 2, 11 and 12, Township 23, Range 29 West of the Principal Meridian;

(b) the reservoir created by the dam, extending approximately 60 km in a generally northward direction, and known as "Lake of the Prairies";

Artificial flooding report

3(1) An artificial flooding report in relation to artificial flooding caused by the operation of the Shellmouth Dam must include the following information:

(a) a statement of the period reported on;

(b) a statement that the minister has determined that damage to eligible property or economic loss has occurred during the reporting period due to artificial flooding caused by the operation of the Shellmouth Dam;

(i) discharges from the Shellmouth Dam, and

(ii) water levels for the Assiniboine River at relevant hydrometric monitoring stations;

(d) charts showing the dates that artificial flooding began and ended for each relevant hydrometric monitoring station;

(e) a description as to how the regulated and unregulated levels were determined;

(f) a description of all Shellmouth Dam operations and any technical issues that arose during the reporting period;

(g) if operating guidelines have been approved for the operation of the Shellmouth Dam, a statement as to whether the dam was operated in a manner consistent with the guidelines during the entire reporting period, and if not, a description of the time period and circumstances in which it was operated in a manner inconsistent with the guidelines;

(h) a tabulation showing all Shellmouth Dam gate adjustments during the reporting period, including

(i) the date and time of each adjustment,

(ii) the reservoir water level and the volume of water stored in the reservoir, at the time of each adjustment, and

(iii) the riparian outlet flow, spillway flow and total outflow resulting from each adjustment.

Rapport concernant une inondation artificielle

3(1) Le rapport concernant une inondation artificielle provoquée par le fonctionnement du barrage Shellmouth :

a) indique la période qu'il vise;

b) indique que le ministre a déterminé que des biens admissibles ont été endommagés ou que des pertes économiques ont été subies au cours de la période visée en raison d'une inondation artificielle provoquée par le fonctionnement du barrage;

Notice of the report's availability

3(2) For the purposes of clause 12.7(3)(b) of the Act, the public availability of the artificial flooding report must be publicized without delay after the report is publicly available by placing a notice of its availability

(a) in the Winnipeg and Brandon locations of the public registry maintained by the Manitoba Department of Conservation under The Environment Act;

(b) at the Winnipeg head office of the Manitoba Department of Water Stewardship and the Brandon regional office of the Manitoba Department of Infrastructure and Transportation; and

Where copies of the report are to be available

3(3) For the purposes of clause 12.7(3)(b) of the Act, the artificial flooding report must be made available to the public

(a) by placing a copy — for reading only — in the Winnipeg and Brandon locations of the public registry maintained by the Manitoba Department of Conservation under The Environment Act;

(b) by posting a copy on the Internet accessible by an Internet link on the home page of the Manitoba Department of Water Stewardship; and

(i) the Winnipeg head office of the Manitoba Department of Water Stewardship and the Brandon regional office of the Manitoba Department of Infrastructure and Transportation, and

(ii) the administration office of any municipality within whose boundaries the report indicates that artificial flooding occurred.

Coming into force

4 This regulation comes into force on the same day that The Shellmouth Dam and Other Water Control Works Management and Compensation Act (Water Resources Administration Act Amended), S.M. 2008, c. 28, comes into force.
