1 The Geophysical Regulation, Manitoba Regulation 110/94, is amended by this regulation.

1 Le présent règlement modifie le Règlement sur les opérations géophysiques, R.M. 110/94.
2 Section 1 is amended by replacing the definition "district office" with the following:
"district office" means the office of the branch specified by the director for an area of the province; (« bureau de district »)
2 La définition de « bureau de district » figurant à l'article 1 est remplacée par ce qui suit :
« bureau de district » Le bureau de la Direction désigné par le directeur pour un territoire donné de la province. ("district office")
3 Clause 2(1)(a) is replaced with the following:
(a) a fee and abandonment levy of $300, consisting of an application fee of $250 and a non-refundable levy of $50 for deposit in the Consolidated Fund in accordance with section 172 of the Act;

Licensee to give notice before operation begins
7(1) Before commencing a geophysical operation, the licensee must give notice of the licensee's estimated beginning and end date of the geophysical operation and the nature and location of the geophysical operation to each of the following:
(a) the director;
(b) if the geophysical operation will be conducted on privately owned land, the occupier of the land on which the geophysical operation will occur;
(c) each municipality or local government district in which the geophysical operation will occur;
(d) if any of the following improvements are located on the land on which the geophysical operation will occur, the owner of or person responsible for the improvement:
(i) a power line,
(ii) a telecommunication line,
(iii) a gas distribution system or pipeline;
(e) if a highway is within the area in which the geophysical operation will occur, the applicable traffic authority within the meaning of The Highway Traffic Act.

e) si une route se situe à proximité de l'emplacement où se déroulera l'opération, à l'autorité chargée de la circulation applicable au sens du Code de la route.
4(2) Clause 7(2)(a) is amended by striking out "the office referred to in clause (1)(b)" and substituting "each municipality or local government district in which the geophysical operation will occur".
4(2) L'alinéa 7(2)a) est modifié par substitution, à « aux bureaux visés à l'alinéa (1)b) », de « à chaque municipalité ou district d'administration locale où se déroulera l'opération géophysique ».
4(3) Subsection 7(4) is amended by striking out "the offices referred to in clauses (1)(a) and (b)" and substituting "the director and each municipality or local government district in which the geophysical operation occurred".

5 Subsections 9(2) and 11(3) of the English version are amended by striking out "he or she" and substituting "the director".

6 Subsection 13(3) of the English version is amended
(a) in the section heading and in the section, by striking out "clause 2(a)" and substituting "clause (2)(a)"; and
(b) by striking out "Ground Water" and substituting "Groundwater".

7 Subsection 15(2) is amended by replacing the part before clause (a) with the following:
