1 The Periodic Mandatory Vehicle Inspection Regulation, Manitoba Regulation 76/94, is amended by this regulation.

1 Le présent règlement modifie le Règlement sur l'inspection périodique et obligatoire des véhicules, R.M. 76/94.
2 Section 1 is amended
(a) by repealing the definition "Act";
(b) by adding the following definitions:
"oil well service vehicle" means a regulated vehicle, including a trailer, that is
(a) specially constructed, altered or equipped to accommodate a specific service requirement associated with the oil or natural gas industry, and
(b) used exclusively in those industries for transporting equipment or materials to and from industry facilities or servicing and repairing those facilities; (« véhicule de service de puits »)
"semi-trailer" means a vehicle without motive power, designed so that a substantial part of its weight and load rests on and is carried by a truck tractor, another semi-trailer or a trailer converter dolly to which it is attached by a fifth wheel coupler; (« semi-remorque »)
(c) in the definition "inspection station", by adding ", Manitoba Regulation 58/2006" at the end.

b) utilisé exclusivement dans ces industries pour le transport de matériel en direction et en provenance de leurs installations ou pour l'entretien ou la réparation de ces dernières. ("oil well service vehicle")
3 Section 2 is amended by adding the following after clause (g):
(h) oil well service vehicles.

4 Section 2.1 is amended
(a) in clause (a), by adding "other than a semi-trailer" after "trailer";
(b) in clause (c), by striking out ", Manitoba Regulation 57/2006,"; and
(c) in clause (h), by striking out ", Manitoba Regulation 57/2006".

5(1) Subsection 3(2) is amended
(a) by adding the following after clause (a):
(a.1) if the classified vehicle is an oil well service vehicle, it is the period beginning on the day an inspection certificate and inspection decal for the classified vehicle are issued and ending on the day four years after the last day of the month in which the inspection certificate and inspection decal were issued;
(b) in clause (b), by adding "or (a.1)" after "clause (a)".

5(2) Subsection 3(4) is amended, in the part before clause (a), by striking out "operator" and substituting "registered owner".

(a) by adding "or" at the end of subclause (a)(ii), striking out "or" at the end of clause (a) and adding the following after clause (a):
(a.1) four years after the last day of the month in which it was issued if the classified vehicle is an oil well service vehicle; or
(b) in clause (b), by adding "or (a.1)" at the end.

6(2) Subsection 5(2.1) is replaced with the following:

5(2.1) Clause (2)(a.1) applies to an inspection certificate issued in relation to an oil well service vehicle that was valid immediately before this section comes into force. The registrar must issue to the vehicle's registered owner a replacement inspection decal that sets forth the certificate's new expiry date.
5(2.1) L'alinéa (2)a.1) s'applique aux certificats d'inspection délivrés à l'égard d'un véhicule de service de puits qui étaient valides la veille de l'entrée en vigueur du présent article. Le registraire délivre au propriétaire inscrit du véhicule un autocollant d'inspection de remplacement indiquant la nouvelle date d'expiration du certificat d'inspection.
5(2.2) Despite subsection (2), a valid inspection certificate expires when the motor vehicle in relation to which it was issued is written off under the Written-off, Irreparable and Salvageable Motor Vehicles Regulation, Manitoba Regulation 41/2006.
