Manitoba Regulation 89/2014 amended
1 The Administrative Penalty Regulation, Manitoba Regulation 89/2014, is amended by this regulation.
Modification du R.M. 89/2014
1 Le présent règlement modifie le Règlement sur les sanctions administratives, R.M. 89/2014.
2 Section 1 is amended in clause (c) of the definition "control measure" by adding "maintenance," after "modification,".
2 L'alinéa c) de la définition de « mesure de protection » figurant à l'article 1 est modifié par adjonction, après « modification, », de « entretien, ».
3 Clause 2(d) of the French version is replaced with the following:
d) s'il s'agit de la première, deuxième ou troisième sanction administrative de la personne, ou d'une sanction administrative subséquente.

4 Section 4 is amended by striking out "in accordance with the Schedule" and substituting "in accordance with the table in the Schedule to this regulation".

5 The following is added after section 4:

Application
4.1 In determining whether an administrative penalty is a person's first, second, third or subsequent administrative penalty for the purpose of the table in the Schedule to this regulation, the following rules apply:
1.If the administrative penalty is issued to a person who was not issued an administrative penalty for the same contravention in the immediately preceding three years, the administrative penalty is a first administrative penalty.
2.If the administrative penalty is issued to a person who was issued a first administrative penalty — as determined under rule 1 — for the same contravention in the immediately preceding three years, the administrative penalty is a second administrative penalty.
3.If the administrative penalty is issued to a person who was issued a second administrative penalty — as determined under rule 2 — for the same contravention in the immediately preceding three years, the administrative penalty is a third administrative penalty.
4.If the administrative penalty is issued to a person who was issued a third administrative penalty — as determined under rule 3 — for the same contravention in the immediately preceding three years, the administrative penalty is a subsequent administrative penalty.
Application
4.1 Pour l'application du tableau de l'annexe du présent règlement, les règles qui suivent s'appliquent pour déterminer si la sanction administrative infligée à une personne constitue sa première, deuxième ou troisième sanction administrative, ou une sanction administrative subséquente :
1.Il s'agit d'une première sanction administrative si aucune sanction administrative n'a été infligée à la personne pour la même contravention au cours des trois années précédentes.
2.Il s'agit d'une deuxième sanction administrative si une première sanction administrative — déterminée en application de la règle 1 — a été infligée à la personne pour la même contravention au cours des trois années précédentes.
3.Il s'agit d'une troisième sanction administrative si une deuxième sanction administrative — déterminée en application de la règle 2 — a été infligée à la personne pour la même contravention au cours des trois années précédentes.
4.Il s'agit d'une sanction administrative subséquente si une troisième sanction administrative — déterminée en application de la règle 3 — a été infligée à la personne pour la même contravention au cours des trois années précédentes.
6 The table in the Schedule is amended
(a) in the French version, in the row before the row respecting item 1, by striking out "Sanction administrative subséquente" and substituting "Troisième sanction administrative ou sanction administrative subséquente";
(b) by adding the following after the row respecting item 2:
6 Le tableau de l'annexe est modifié :
a) dans la version française, dans la rangée précédant la rangée concernant le point 1, par substitution, à « Sanction administrative subséquente », de « Troisième sanction administrative ou sanction administrative subséquente »;
b) par adjonction, après la rangée concernant le point 2, de la rangée suivante :
