Manitoba Regulation 152/2017 amended
1 The Agricultural Crown Lands Leases and Permits Regulation, Manitoba Regulation 152/2017, is amended by this regulation.

2 Subsection 8.5(1) is amended by striking out "December 31, 2025" and substituting "December 31, 2026".

3 Section 10.2 is amended, in the section heading and in the part before the formula, by striking out "2025" and substituting "2025 and 2026".

Adjustment — change in use or access
10.3(1) Despite subsection 10(4) and section 10.2, the director may decrease the annual rent or annual fee for an agricultural lease or permit (other than a cropping lease or a cropping permit) by an amount proportionate to a decrease in forage capacity of the land due to a change in use of or access to the land initiated by the government.

10.3(1) Malgré le paragraphe 10(4) et l'article 10.2, le directeur peut réduire le loyer ou droit annuel concernant un bail ou permis agricole (autre qu'un bail de culture ou un permis de culture) d'un montant proportionnel à une réduction de la capacité fourragère des biens-fonds découlant d'une modification de l'usage des biens-fonds ou du droit d'y accéder proposée par le gouvernement.
10.3(2) The decrease to the annual rent or annual fee takes effect on January 1 of the year after the year in which the change occurred.

5(1) Subsection 19(2) is amended by striking out "A former" and substituting "Subject to subsection (2.1), a former".

5(2) The following is added after subsection 19(2):

19(2.1) If the former holder is not able to remove the improvements made by the former holder to the leased or permitted lands within 30 days after the expiry or cancellation due to circumstances beyond the former holder's control, the former holder may apply to the director requesting an extension and the director may extend the time period.
19(2.1) L'ancien titulaire qui, en raison de circonstances indépendantes de sa volonté, n'est pas en mesure d'enlever, dans les 30 jours suivant l'expiration ou l'annulation de son bail ou permis, les améliorations qu'il a apportées aux biens-fonds loués ou visés par le permis peut demander au directeur une prorogation du délai, laquelle peut lui être accordée par ce dernier.
19(2.2) An application for an extension under subsection (2.1) must
(a) be made before the expiry or cancellation of the lease or permit in a form acceptable to the director; and
(b) include the reason for the request.
19(2.2) Les demandes de prorogation visées au paragraphe (2.1) sont motivées et présentées avant l'expiration ou l'annulation du bail ou du permis en la forme que le directeur juge acceptable.
5(3) Subsection 19(3) is amended by striking out "subsection (2)" and substituting "subsection (2) or (2.1)".

6 Subsection 27.5(1) is amended by adding ", subject to any adjustment made by the director under section 10.3" at the end.
