Manitoba Regulation 120/2018 amended
1 The Cannabis Regulation, Manitoba Regulation 120/2018, is amended by this regulation.
2 Subsection 1(1) is amended by adding the following definition:
"illicit cannabis" means illicit cannabis as defined in the Cannabis Act (Canada).
3 The following is added after subsection 2.2(2):
2.2(3) A person who is cultivating cannabis in their residence in accordance with Part 5 may possess cannabis that they have cultivated that is not packaged, labelled and stamped in accordance with the requirements of subsection 101.15.2(2) of the Act while that cannabis is in their residence.
4 Section 7 is repealed.
5 Section 14 is amended by renumbering it as subsection 14(1) and adding the following as subsection 14(2):
14(2) A licensee must not sell more than four cannabis plants to a person in a single transaction.
6 Section 21 is repealed.
7 The heading for Part 4 is amended by adding "RE LICENSEES" after "GENERAL PROVISIONS".
8 The following is added after section 48:
PART 5
RESIDENTIAL CULTIVATION OF CANNABIS
Who may engage in residential cultivation of cannabis
49(1) Subject to subsections (2) and (3), a person who is 19 years of age or over may cultivate up to four cannabis plants in their ordinary residence.
49(2) A person must not cultivate cannabis plants at different residences at the same time.
49(3) If two or more persons who are 19 years of age or over ordinarily reside at the same residence, any of those persons must not cultivate a cannabis plant if doing so results in more than four cannabis plants being cultivated in that residence at any one time.
Residential cannabis cultivation requirements
50 A person cultivating cannabis in their residence must comply with the following requirements:
(a) all cannabis plants cultivated must be from seeds or plant material that is not illicit cannabis;
(b) all cannabis plants must be cultivated indoors in a room or container that is securely locked or in a location that is not otherwise accessible to young persons.
Coming into force
9 This regulation comes into force on the same day that The Liquor, Gaming and Cannabis Control Amendment Act, S.M. 2024, c. 22, comes into force.
