Manitoba Regulation 89/2001 amended
1 The Manitoba Prenatal Benefit Regulation, Manitoba Regulation 89/2001, is amended by this regulation.

2 Section 1 is amended in clause (a) of the definition "net income" by adding ", less any shelter assistance received under Part 3 of the Assistance Regulation, Manitoba Regulation 404/88 R" after "Canada Revenue Agency".

3 Clause 2(1)(a) is replaced with the following:

8 Beginning on the day this section comes into force
(a) an applicant with a net family income of not more than $21,744.00 for the applicable base taxation year, or the current year if section 7 applies, is eligible to receive a prenatal benefit in the maximum amount of $162.82 each month for the period during which prenatal benefits are payable under this regulation; and
(b) an applicant with a net family income between $21,744.00 and $31,999.99 for the applicable base taxation year, or the current year if section 7 applies, is eligible to receive a prenatal benefit based on the maximum benefit of $162.82 each month reduced by 9.525% per year for each dollar of net family income above $21,744.00 but no prenatal benefit is less than $10.00 each month under this clause.

Payment of prenatal benefit
9(1) If an applicant is eligible to receive a prenatal benefit under section 3, the applicant is to receive a payment for the month in which they are 14 weeks pregnant and for every subsequent month until the prenatal benefit ends under section 10.

When payment of prenatal benefits ends
10(1) A prenatal benefit is payable monthly until the participant has received six months of prenatal benefits or an amount that is equal to six months of prenatal benefits.

10(2) Despite subsection (1), if one of the following events occurs before the participant has received six months of prenatal benefits or an amount that is equal to six months of prenatal benefits, payment of benefits will end in the month in which the event occurs:
(a) the pregnancy ends prematurely;
(b) the participant requests that payment of prenatal benefits be terminated;
(c) the participant ceases to live in Manitoba;
(d) the participant ceases to be eligible for a prenatal benefit under this regulation;
(e) the participant dies.
10(2) Malgré le paragraphe (1), si l'un des événements indiqués ci-après se produit avant que la participante ne reçoive six mois d'allocation prénatale ou un montant équivalant à six mois de celle-ci, le versement de l'allocation prend fin au cours du mois où survient l'événement :

Transitional
8(1) A participant who is receiving a prenatal benefit on the day this regulation comes into force is to receive an amount of prenatal benefit calculated in accordance with section 8, as enacted by section 6 of this regulation, for the remainder of their prenatal benefit eligibility.

8(2) If a participant began receiving a prenatal benefit after the month in which they were 14 weeks pregnant and is still receiving a prenatal benefit on the day this regulation comes into force, the participant is to receive a prenatal benefit as set out in sections 9 and 10, as enacted by section 7 of this regulation.
