THE WESTMINSTER UNITED CHURCH FOUNDATION INCORPORATION AMENDMENT ACT

WHEREAS the Westminster United Church Foundation was incorporated by An Act to incorporate Westminster United Church Foundation, S.M. 1968, c. 102;

AND WHEREAS the corporation was continued by The Westminster United Church Foundation Incorporation Act, R.S.M. 1990, c. 212;

AND WHEREAS the corporation has presented a petition requesting the following amendments to that Act, and it is appropriate to grant the petition;

THEREFORE HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

R.S.M. 1990, c. 212 amended

1   The Westminster United Church Foundation Incorporation Act is amended by this Act.

2   Subsection 8(1) is amended

(a) in clauses (b) and (c) of the English version, by striking out "Chairman" and substituting "Chair"; and

(b) by replacing clause (d) with the following:

(d) the immediate past Chair of the General Board of Westminster United Church or if the position is vacant, the Vice-Chair of the General Board of Westminster United Church;

3   Section 14 is replaced with the following:

Dissolution

14   On the dissolution of the Foundation and after payment of all its debts and liabilities, its remaining assets must be distributed to other registered charities as determined by the board.

Coming into force

4   This Act comes into force on the day it receives royal assent.

Explanatory Note

The Westminster United Church Foundation Incorporation Act is amended. If the immediate past Chair position is vacant, the Vice-Chair of the General Board of Westminster United Church is to serve on the board of trustees. In addition, the Foundation's assets are to be distributed to registered charities as determined by the board of trustees if the Foundation is dissolved.
