THE HIGHWAY TRAFFIC AMENDMENT ACT (IMPAIRED DRIVING MEASURES)

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. H60 amended

1   The Highway Traffic Act is amended by this Act.

2   Clause 252(b) is amended by striking out "subsection 264(1.1), (1.2.1), (1.2.3) or (6.1)" and substituting "subsection 264(1.1), (1.2.1), (1.2.3.1) or (6.1)".

3(1)   Subsection 264(1) is amended by replacing the definition "designated impaired offence" with the following:

"designated impaired offence" means an offence referred to in clause (a) or subclause (a.2)(i) of the definition "Category B offence"; (« infraction désignée pour conduite avec facultés affaiblies »)

3(2)   Subsection 264(1.1) is amended, in the part before the table, by striking out "subsections (1.2) and (1.2.3)" and substituting "subsections (1.2), (1.2.3) and (1.2.3.1)".

3(3)   Subsection 264(1.2.3) is replaced with the following:

30-year suspension for designated impaired offence

264(1.2.3)   Despite subsection (1.1), when a person is convicted of a designated impaired offence, the person's licence and right to have a licence is suspended and the person is disqualified from driving a motor vehicle for a 30-year period.

Lifetime suspension for second designated impaired offence

264(1.2.3.1)   Despite subsection (1.1), when a person is convicted of a second designated impaired offence, the person's licence and right to have a licence is permanently suspended and the person is disqualified from driving a motor vehicle for the rest of their life.

3(4)   Subsection 264(1.2.4) is repealed.

3(5)   Subsection 264(1.3) is amended, in the part before clause (a), by striking out "subsection (1.1), (1.2), (1.2.1) or (1.2.3)" and substituting "subsection (1.1), (1.2), (1.2.1), (1.2.3) or (1.2.3.1)".

3(6)   Subsection 264(7) is amended by striking out "subsection (1.1), (1.2.1), (1.2.3) or (6.1)" and substituting "subsection (1.1), (1.2.1), (1.2.3), (1.2.3.1) or (6.1)".

Coming into force

4   This Act comes into force on the day it receives royal assent.

Explanatory Note

The Highway Traffic Act is amended to impose additional consequences when an impaired driving offence involves bodily injury or death.

A 30-year licence suspension is imposed on a person when they are convicted of such an offence and a lifetime suspension is imposed for a second conviction.
