THE RESIDENCY REQUIREMENTS FOR ELECTIONS ACT (VARIOUS ACTS AMENDED)

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
THE ELECTIONS ACT
C.C.S.M. c. E30 amended
1 The following provisions of The Elections Act are amended by striking out "six months" and substituting "three months":
(a) clause 5(b);
(b) clauses 8(a) and (b);
(c) clauses 9(1)(a) and (b);
(d) subclause 12(1)(c)(i);
(e) clause 53(1)(b).
THE MUNICIPAL ACT
C.C.S.M. c. M225 amended
2 Clause 113(1.1)(b) of The Municipal Act is amended, in the part before subclause (i), by striking out "six months" and substituting "three months".
THE MUNICIPAL COUNCILS AND SCHOOL BOARDS ELECTIONS ACT
C.C.S.M. c. M257 amended
3 The following provisions of The Municipal Councils and School Boards Elections Act are amended by striking out "six months" and substituting "three months":
(a) clause 21(1)(b);
(b) subsection 21(5);
(c) clause 21.1(2)(b);
(d) clause 22(1)(b);
(e) subsection 22(3).
THE NORTHERN AFFAIRS ACT
C.C.S.M. c. N100 amended
4(1) The Northern Affairs Act is amended by this section.
4(2) Clause 82(1)(b) is amended by striking out "six months" and substituting "three months".
4(3) Subsection 82(5) is amended by striking out "six months" and substituting "three months".
THE PUBLIC SCHOOLS ACT
C.C.S.M. c. P250 amended
5(1) The Public Schools Act is amended by this section.
5(2) Subsection 17(5) is amended by striking out "six months" and substituting "three months".
5(3) The following provisions are amended by striking out "six months" and substituting "three months":
(a) clause 21.37(2)(b);
(b) subclause 21.38(1)(b)(iii);
(c) clause 22(1)(c) in the part after subclause (ii);
(d) clause 24.2(5)(c) in the part after subclause (ii).
Consequential amendment, Manitoba Regulation 202/93
6 The following provisions of the Francophone Schools Governance Regulation, Manitoba Regulation 202/93, are amended by striking out "six months" and substituting "three months":
(a) clause 11(b);
(b) the form in Schedule F.
TRANSITIONAL AND COMING INTO FORCE
Elections held within 180 days
7 The amendments made by this Act do not apply to an election or vote that is held within 180 days after the day this Act comes into force.
Coming into force
8 This Act comes into force on the day it receives royal assent.

Explanatory Note The Elections Act, The Municipal Act, The Municipal Councils and School Boards Elections Act, The Northern Affairs Act, The Public Schools Act and the Francophone Schools Governance Regulation are amended. The minimum residency period required to participate in provincial, municipal and other local elections and votes is shortened from six months to three months. |
