THE MUNICIPAL COUNCILS AND SCHOOL BOARDS ELECTIONS AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. M257 amended

1   The Municipal Councils and School Boards Elections Act is amended by this Act.

2(1)   Subsection 22(1) is replaced with the following:

Eligibility of non-resident

22(1)   Subject to subsection (2), a person who is not a resident of a local authority is eligible to vote in an election or on a question if the person is

(a) a Canadian citizen and is at least 18 years old on election day; and

(b) a registered owner of land in the local authority on election day and has been so for at least the six months before election day.

2(2)   Subsection 22(3) is amended by striking out "municipality" wherever it occurs and substituting "local authority".

Consequential amendment, C.C.S.M. c. P250

3   Item 2 of Form 1 in Schedule D to The Public Schools Act is amended by striking out "an actual resident elector" and substituting "a voter".

Coming into force

4   This Act comes into force 180 days after the day it receives royal assent.

Explanatory Note

The Municipal Councils and School Boards Elections Act is amended to enable non-resident property owners to vote in school board elections.

Voting is limited to two non-resident owners per property.

A consequential amendment is made to The Public Schools Act.
