THE SMOKING AND VAPOUR PRODUCTS CONTROL AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. S150 amended

1   The Smoking and Vapour Products Control Act is amended by this Act.

2   The centred heading "INTERPRETATION" is added before section 1.

3   Subsection 1(1) is amended by adding the following definitions:

"flavoured e-substance" means an e-substance that has a noticeable aroma or flavour when it is vapourized in an e-cigarette; (« substance aromatisée servant à vapoter »)

"major urban area" means a city or town prescribed by regulation; (« zone urbaine d'importance » )

4   The centred heading "PROHIBITIONS ON SMOKING AND E-CIGARETTE USE" is added before section 2.

5   The centred heading "SUPPLY OF TOBACCO AND VAPOUR PRODUCTS" is added before section 6.3.

6   The following is added after section 6.3:

Sale of flavoured e-substances in major urban areas

6.3.1(1)   No person shall sell or offer to sell a flavoured e-substance in a major urban area except in business premises that children are prohibited from entering.

Exempt products

6.3.1(2)   Subsection (1) does not apply to an e-substance that has the aroma or flavour of tobacco but has no other noticeable aroma or flavour.

No children in age-restricted business premises

6.3.2   The proprietor of age-restricted business premises in a major urban area in which flavoured e-substances may be sold or offered for sale under subsection 6.3.1(1) must not allow a child to enter the premises.

7   The centred heading "RESTRICTIONS ON DISPLAY AND ADVERTISING" is added before section 7.1.

8   The centred heading "ENFORCEMENT" is added before section 7.4.

9   The centred heading "OFFENCES AND PENALTIES" is added before section 8.

10   The centred heading "GENERAL PROVISIONS" is added before section 9.

11   The following is added after clause 9(1)(a.0.2):

(a.0.3) prescribing cities and towns for the purpose of the definition "major urban area";

Coming into force

12   This Act comes into force on a day to be fixed by proclamation.
