THE APPRENTICESHIP AND CERTIFICATION AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

1 The Apprenticeship and Certification Act is amended by this Act.
2 Section 1 is amended by adding the following definitions:
"approved service provider" means an educational institution, corporation or organization that has entered into an agreement with the executive director to provide technical training, education or other services under the Act. (« fournisseur de services approuvé »)
"personal information" means personal information as defined in The Freedom of Information and Protection of Privacy Act. (« renseignements personnels »)
3(1) Clause 42(1)(a) is amended by adding "an approved service provider," after "or the regulations to".
3(2) Subsection 42(2) is replaced with the following:
Restriction on sharing personal information
42(2) The information provided under subsection (1) may include personal information, but the amount of personal information provided must be restricted to the minimum amount required for the purpose of that subsection.
4 The following is added after section 42 and before the centred heading "SERVICE OF DOCUMENTS":

Registry
42.1(1) Within 60 days after the coming into force of this section, the executive director must establish an online registry that provides a means for members of the public to confirm the qualifications of specified persons who are subject to this Act.
Information in registry
42.1(2) The registry must contain prescribed information respecting
(a) every person who holds a certificate of qualification in a designated trade;
(b) every person who holds an occupational certificate in a designated occupation; and
(c) every person who is part of a prescribed class of persons who are subject to this Act.
5 The following is added after clause 46(1)(r):
(r.1) respecting the registry established under section 42.1, including
(i) information to be contained in the registry, and
(ii) any additional classes of persons to be included in the registry;
Coming into force
6 This Act comes into force on the day it receives royal assent.

Explanatory Note The Apprenticeship and Certification Act is amended to require an online public registry to be established that provides information about journeypersons and other specified persons who are subject to the Act. The executive director is authorized to share information with educational institutions and other persons providing technical training or other services under the Act. |
