THE PROMOTING INCLUSION IN AMATEUR SPORT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

INTRODUCTORY PROVISIONS

Definitions

1   The following definitions apply in this Act.

"inclusion policy" means the inclusion policy established by Sport Manitoba under section 3. (« politique d'inclusion »)

"participant assessment" means an assessment of the participants in a sport conducted under section 6. (« évaluation des participants »)

"provincial sport organization" means

(a) an association or organization recognized by Sport Manitoba that organizes or oversees the operation of a sport in Manitoba and which, directly or indirectly, receives government funding; or

(b) an association, organization or entity prescribed by regulation. (« organisme sportif provincial »)

"Sport Manitoba" means Sport Manitoba Inc., a corporation established under The Corporations Act. (« Sport Manitoba »)

Purpose

2   The purpose of this Act is to promote the participation of persons from underrepresented groups in sports to reflect the diversity of Manitoba.

INCLUSION POLICY

Inclusion policy

3(1)   Sport Manitoba must establish an inclusion policy that is designed to increase the participation of persons from underrepresented groups in sports.

3(2)   Sport Manitoba must make the inclusion policy available to the public by posting the policy on its website.

Provincial sport organizations must adopt policy

4   Each provincial sport organization must adopt and implement the inclusion policy in the organization and administration of its sport.

INCLUSION EDUCATION

Inclusion courses

5(1)   Sport Manitoba must prepare or approve one or more courses that provide training on enhancing inclusion for provincial sport organizations.

Board and staff must complete courses

5(2)   All board members and staff of a provincial sport organization must complete the inclusion courses within six months after the coming into force of this Act or within six months after assuming their position if they assume their position after this Act comes into force.

PARTICIPANT ASSESSMENT

Participant assessment

6(1)   A provincial sport organization must conduct an assessment of participants in its sport to obtain general demographic information about the participants to determine if there are underrepresented groups in the sport.

Guidelines for participant assessment

6(2)   The participant assessment is to be conducted in accordance with guidelines established by Sport Manitoba or requirements established by regulation.

When participant assessment to be conducted

7   A provincial sport organization must conduct a participant assessment

(a) within one year after this Act comes into force; and

(b) whenever Sport Manitoba directs it to conduct another participant assessment.

8   A provincial sport organization must give the results of its participant assessment to Sport Manitoba once the assessment has been completed.

REPORTING

Annual report to Sport Manitoba

9   A provincial sport organization must provide Sport Manitoba with a report each year that

(a) sets out the programs, initiatives or changes in rules or policies implemented by the organization that year to increase the participation of persons from underrepresented groups in the sport; and

(b) evaluates the outcomes of each program, initiative or change in rules or policies in increasing the participation of persons from underrepresented groups in the sport.

REGULATIONS

Regulations

10   The Lieutenant Governor in Council may make regulations

(a) prescribing associations, organizations or other entities as provincial sport organizations;

(b) respecting the manner in which participant assessments are to be conducted;

(c) defining any word or expression used but not defined in this Act;

(d) respecting any matter the Lieutenant Governor in Council considers necessary or advisable to carry out the purpose of this Act.

11   This Act may be referred to as chapter P142 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

12   This Act comes into force on a day to be fixed by proclamation.

Explanatory Note

The Promoting Inclusion in Amateur Sport Act is established.

Each provincial sport organization must adopt an inclusion policy that promotes the participation of persons from underrepresented groups in the sport. A provincial sport organization's board members and staff must complete inclusion courses specified by Sport Manitoba.

A provincial sport organization must conduct an assessment of participants in its sport to determine if there are underrepresented groups in the sport. The organization must prepare a report each year that reviews its efforts to increase participation in the sport.
