THE ADULT ABUSE REGISTRY AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

1 The Adult Abuse Registry Act is amended by this Act.
2 Section 17 is replaced with the following:
Committee to review designated officer's report
17 When the committee receives a report from a designated officer in which it is alleged that a person abused or neglected a specified adult, the committee must review the report in accordance with this Act.
3 Section 19 is replaced with the following:
Opportunity to provide information to committee
19 In accordance with the regulations, the committee must give the person alleged in the report to have abused or neglected a specified adult an opportunity to provide information to the committee.
4 Clause 20(b) is amended by striking out "who is suspected of abusing or neglecting" and substituting "alleged in the report to have abused or neglected".
5 Clause 21(1.1)(a) is replaced with the following:
(a) to the person alleged in the report to have abused or neglected the specified adult;
Transition — reports received
6(1) The provisions of the former Act apply to a report received by the committee before the coming into force of this section if the committee has considered the report under section 19 of the former Act.
Definition of "former Act"
6(2) In subsection (1), "former Act" means The Adult Abuse Registry Act as it read immediately before the coming into force of this section.
Coming into force
7 This Act comes into force on a day to be fixed by proclamation.

Explanatory Note The Adult Abuse Registry Act is amended to streamline the Adult Abuse Registry Committee process while preserving procedural fairness. The committee must determine whether a person abused or neglected a specified adult after a single hearing. The person continues to have an opportunity to provide information to the committee. |
