THE LOCAL ELECTIONS VOTER ELIGIBILITY ACT (VARIOUS ACTS AMENDED)

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. M257 amended

1(1)   The Municipal Councils and School Boards Elections Act is amended by this section.

1(2)   Subsection 21(1) is amended

(a) in the part before clause (a) of the English version, by striking out "he or she is" and substituting "the person is"; and

(b) by replacing clause (a) with the following:

(a) a Canadian citizen or permanent resident within the meaning of the Immigration and Refugee Protection Act (Canada) and at least 16 years old on election day; and

1(3)   Subsection 22(1) is amended

(a) in the part before clause (a), by striking out "he or she is" and substituting "the person"; and

(b) by replacing clause (a) with the following:

(a) is a Canadian citizen or permanent resident within the meaning of the Immigration and Refugee Protection Act (Canada) and at least 16 years old on election day; and

C.C.S.M. c. N100 amended

2   Subsection 82(1) of The Northern Affairs Act is amended

(a) in the part before clause (a) of the English version, by striking out "he or she is" and substituting "the person is"; and

(b) by replacing clause (a) with the following:

(a) a Canadian citizen or permanent resident within the meaning of the Immigration and Refugee Protection Act (Canada) and at least 16 years of age; and

C.C.S.M. c. P250 amended

3(1)   The Public Schools Act is amended by this section.

3(2)   Subsection 21.37(2) is replaced with the following:

Qualifications of voters

21.37(2)   A person is entitled to vote in an election of trustees of the francophone school division if, on the day of the election, the person

(a) is 16 years of age or older;

(b) is a Canadian citizen or permanent resident as defined in the Immigration and Refugee Protection Act (Canada) who has been a resident of Manitoba for at least six months;

(c) is either of the following:

(i) a parent

(A) whose child is enrolled in a program provided by the francophone school board, or

(B) who resides in an electoral division of the francophone school division, and is an entitled person who in the year before the general election requested the francophone school board to provide instruction for their school-age child, but whose child is not yet enrolled in a program provided by the francophone school board,

(ii) a student who is enrolled in a program provided by the francophone school board; and

(d) is not disqualified under this Act or any other Act and is not otherwise prohibited by law from voting in school division or school district elections.

3(3)   Subclause 21.43(e)(iii) is replaced with the following:

(iii) for the purpose of paragraph 21.37(2)(c)(i)(B), specifying when and in what manner a person must indicate a wish to have instruction provided for their child,

Coming into force

4   This Act comes into force on the day it receives royal assent.

Explanatory Note

The Municipal Councils and School Boards Elections Act and The Northern Affairs Act are amended to lower the voting age to 16 and to allow permanent residents of Canada to vote in municipal, school board and community council elections.

The Public Schools Act is amended to lower the voting age to 16 and to allow permanent residents and students enrolled in a program provided by a francophone school board to vote in elections for that board.
