THE MANITOBA PUBLIC INSURANCE CORPORATION AMENDMENT ACT (2)

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
C.C.S.M. c. P215 amended
1 The Manitoba Public Insurance Corporation Act is amended by this Act.
2(1) Subsection 6.1(1) is amended by striking out "For the period after February 28, 2019, the corporation" and substituting "The corporation".
2(2) Subsection 6.1(3) is amended by striking out everything after "blanket certificate".
2(3) The following is added after subsection 6.1(3):
Discount based on owner's driver safety rating
6.1(3.0.1) Subject to subsection (3.0.2), a discount from a plan premium under subsection (3) must be based on the driver safety rating of the owner in whose name the motor vehicle is registered under The Drivers and Vehicles Act.
Exception for prescribed drivers
6.1(3.0.2) If the owner in whose name the motor vehicle is registered does not hold a valid driver's licence within the meaning of The Drivers and Vehicles Act, a discount from the plan premium under subsection (3) may, in circumstances set out in the regulations, be based on the driver safety rating of a person prescribed in the regulations.
2(4) Subsection 6.1(6) is repealed.
3 Clause 33(1)(h) is replaced with the following:
(h) establishing a driver safety rating system to rate a person based on the input factors recorded in their driver record, or on the absence of input factors in the record over time, for the purpose of determining a plan premium or the premium that the person must pay for a driver's certificate;
Coming into force
4 This Act comes into force on the day it receives royal assent.

Explanatory Note The Manitoba Public Insurance Corporation Act is amended to clarify that any discount from a premium payable to insure a vehicle must be based on the driver safety rating of the registered owner of the vehicle. Under the regulations, an exception may be made to this requirement. |
