THE MANITOBA PUBLIC INSURANCE CORPORATION AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. P215 amended

1   The Manitoba Public Insurance Corporation Act is amended by this Act.

2   Subsection 1(1) is amended

(a) by adding the following definitions:

"blanket certificate" means a blanket certificate issued by the corporation in accordance with section 6.7; (« certificat d'assurance globale »)

"fleet owner" means the owner of motor vehicles insured as a fleet under a plan; (« propriétaire d'un parc de véhicules »)

(b) in the definition "plan premium",

(i) in the part before clause (a), by adding "or blanket certificate" after "owner's certificate", and

(ii) in clause (a), by striking out "subsection 6.1(3)" and substituting "subsection 6.1(3) or (3.2)".

3(1)   Subsection 6.1(3) is amended by adding "other than a fleet owner or holder of a blanket certificate," after "applicant for insurance,".

3(2)   Subsection 6.1(3.1) is replaced with the following:

Surcharges and rebates

6.1(3.1)   Subject to subsection (3.2), the corporation may establish a surcharge that must be paid by, or a rebate of premiums the corporation must pay to, an insured who is a fleet owner or holder of a blanket certificate that is based on the loss experience in respect of a policy during a rating term.

Plan premiums — blanket certificates and fleets

6.1(3.2)   Beginning on a date specified in the regulations, the corporation may, instead of determining premiums under subsection (3.1), establish discounts from the plan premiums otherwise payable, and may establish additional amounts that must be paid as part of plan premiums, by

(a) a fleet owner or a person applying for an owner's certificate for a vehicle that, if issued, would result in the vehicle being part of a fleet; and

(b) a holder of, or applicant for, a blanket certificate;

based on the loss experience of the insured or applicant for insurance.

Different days may be specified

6.1(3.3)   For certainty, the date specified in the regulations for plan premiums to be determined under subsection (3.2) for fleet owners may be different from the date specified for holders of blanket certificates.

4(1)   Section 6.2 is amended by renumbering it as subsection 6.2(1) and replacing the section heading with "Premium payable for owner's certificate".

4(2)   The following is added as subsection 6.2(2):

Premium payable for blanket certificate

6.2(2)   The premium payable for a blanket certificate is the plan premium established by the corporation for the blanket certificate, as determined by the corporation.

5   Subsection 33(1) is amended by adding the following after clause (b.2):

(b.3) specifying the date on which plan premiums for fleet owners and for holders of blanket certificates are to be determined under subsection 6.1(3.2);

6   Clause 48(1)(b) is amended by striking out "section 6.2" and substituting "subsection 6.2(1)".

Coming into force

7   This Act comes into force on the day it receives royal assent.

Explanatory Note

Under amendments to The Manitoba Public Insurance Corporation Act, premiums payable by the owner of a fleet of vehicles or the holder of a blanket certificate are to be based on the previous loss experience of the owner or holder. Rebates or surcharges respecting these premiums will no longer be paid or required.

This change begins on a date set by regulation.
