THE COMMUNITY CHILD CARE STANDARDS AMENDMENT AND EDUCATION ADMINISTRATION AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

PART 1
THE COMMUNITY CHILD CARE STANDARDS ACT

C.C.S.M. c. C158 amended

1   The Community Child Care Standards Act is amended by this Part.

2   The following is added after section 3:

First Nations, Inuit and Métis early learning and child care policy framework

3.1(1)   The minister must establish a First Nations, Inuit and Métis early learning and child care policy framework to support positive outcomes for First Nations, Inuit and Métis children who attend facilities.

Timing and updates

3.1(2)   The policy framework must be established not later than three years after the coming into force of this section and must be updated every fifth year after that.

Content

3.1(3)   The policy framework must

(a) support

(i) the provision of culturally safe opportunities for First Nations, Inuit and Métis children who attend facilities to explore their identity and culture, and

(ii) children who attend facilities to develop an understanding and respect for the cultures and perspectives of First Nations, Inuit and Métis; and

(b) set out

(i) the activities that the minister intends to undertake in the applicable five-year period to further the purpose of the policy framework,

(ii) the criteria for ensuring that the program of activities for facilities reflects the perspectives and worldviews of First Nations, Inuit and Métis,

(iii) the measures to be implemented to support the professional development of licence holders of child care homes, facility staff and others who participate in the program of activities for facilities, and

(iv) the process for monitoring and reporting on the implementation of the policy framework.

Consultation

3.1(4)   In preparing the policy framework or an update to it, the minister must consult with First Nations, Inuit and Métis people and organizations.

Framework publicly available

3.1(5)   The minister must make the policy framework available to the public by publishing it on a government website and by any other means the minister considers advisable.

3   The following is added after section 29:

Regard for policy framework

29.1   In approving or establishing qualifications and training of staff for facilities under this Act or the regulations, the minister, the provincial director and the committee are to have regard for the First Nations, Inuit and Métis early learning and child care policy framework established under section 3.1.

PART 2
THE EDUCATION ADMINISTRATION ACT

4   The Education Administration Act is amended by this Part.

5   The following is added after subsection 3(2):

Regard for policy framework

3(3)   In approving or establishing courses of study and in approving teacher education programs, the minister is to have regard for the First Nations, Inuit and Métis education policy framework established under section 4.3.

6   The following is added after clause 3.2(3)(e):

(e.1) develop and implement the First Nations, Inuit and Métis education policy framework established under section 4.3 and determine whether its purpose is being achieved;

7   The following is added after section 4.2:

First Nations, Inuit and Métis education policy framework

4.3(1)   The minister must establish a First Nations, Inuit and Métis education policy framework to support the educational success of First Nations, Inuit and Métis pupils.

Timing and updates

4.3(2)   The policy framework must be established before the beginning of the 2027 school year and must be updated before the beginning of every fifth school year after that.

Content

4.3(3)   The policy framework must

(a) provide for the education of all pupils about truth and reconciliation, treaties, colonial history, the ongoing impacts of colonization and the contributions of First Nations, Inuit and Métis; and

(b) set out

(i) the activities that the minister intends to undertake in the applicable five-year period to further the purpose of the policy framework,

(ii) the criteria for ensuring that the curriculum reflects the perspectives and worldviews of First Nations, Inuit and Métis,

(iii) the measures to be implemented to support the professional development of teachers and others who participate in classroom activities, and

(iv) the process for monitoring and reporting on the implementation of the policy framework.

4.3(4)   In preparing the policy framework or an update to it, the minister must consult with First Nations, Inuit and Métis people and organizations.

4.3(5)   The minister must make the policy framework available to the public by publishing it on a government website and by any other means the minister considers advisable.

PART 3
COMING INTO FORCE

Coming into force

8   This Act comes into force on the day it receives royal assent.

Explanatory Note

Under amendments to The Community Child Care Standards Act and The Education Administration Act, the minister must establish policy frameworks for First Nations, Inuit and Métis education.

The policy frameworks are to set out activities, criteria and measures in licensed early learning and child care environments and the public school system to

support the learning and development of First Nations, Inuit and Métis children; and

ensure that all Manitoba children are educated about truth and reconciliation, treaties, colonial history, the ongoing impacts of colonization and the contributions of First Nations, Inuit and Métis.
