HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
PART 1
GENERAL
THE ADULTS LIVING WITH AN INTELLECTUAL DISABILITY ACT
C.C.S.M. c. A6.1 amended
1(1) The Adults Living with an Intellectual Disability Act is amended by this section.
1(2) Subsection 1(1) is amended by repealing the definition "developmental centre".
1(3) The following is added after subsection 34(3):
Members remain on roster
34(3.1) A member of the hearing panel roster remains on the roster until they are reappointed, a successor is appointed or the appointment is revoked.
1(4) Sections 63 to 67 are repealed.
1(5) Subsection 147(1) is amended by adding "or" at the end of clause (a.1) and repealing clause (b).
1(6) Section 163 is amended
(a) by repealing clauses (a) and (j);
(b) in clause (k), by striking out "by developmental centres or";
(c) by repealing clause (l); and
(d) in clause (m), by striking out "sections 165 to 169" and substituting "section 165".
1(7) Sections 166 to 169 are repealed.
Consequential amendment, C.C.S.M. c. E30
2 Section 1 of The Elections Act is amended in the definition "health care facility" by adding "or" at the end of clause (a), striking out "or" at the end of clause (b) and repealing clause (c).
Consequential amendments, C.C.S.M. c. F52
3(1) The Fatality Inquiries Act is amended by this section.
3(2) Clause 7.1(1)(k) is amended by striking out "or a developmental centre under The Adults Living with an Intellectual Disability Act".
3(3) Clause 19(5)(b) is amended by adding "or" at the end of subclause (ii), striking out "or" at the end of subclause (iii) and repealing subclause (iv).
3(4) Subsection 43(1) is amended
(a) in the part before clause (a), by striking out "or while a resident in a developmental centre as defined in The Adults Living with an Intellectual Disability Act,"; and
(b) in clause (a), by striking out "or developmental centre".
Consequential amendment, C.C.S.M. c. M226
4 Subsection 1(1) of The Municipal Assessment Act is amended in the definition "hospital" by adding "or" at the end of clause (c) and repealing clause (d).
Consequential amendment, C.C.S.M. c. M257
5 Section 1 of The Municipal Councils and School Boards Elections Act is amended in the definition "health care facility" by adding "and" at the end of clause (a), striking out "and" at the end of clause (b) and repealing clause (c).
Consequential amendments, C.C.S.M. c. P10
6(1) The Parents' Maintenance Act is amended by this section.
6(2) Section 4 is amended by striking out "or hospital, mental health clinic, psychiatric facility as defined in The Mental Health Act, developmental centre as defined in The Adults Living with an Intellectual Disability Act," and substituting "hospital, mental health clinic, psychiatric facility as defined in The Mental Health Act".
6(3) Section 10 is amended
(a) in clause (a), by striking out "house of refuge, a psychiatric facility as defined in The Mental Health Act, or a developmental centre as defined in The Adults Living with an Intellectual Disability Act" and substituting "a house of refuge or a psychiatric facility as defined in The Mental Health Act"; and
(b) in subclause (b)(i), by striking out ", psychiatric facility or developmental centre" and substituting "or psychiatric facility".
Consequential amendment, C.C.S.M. c. P300
7 Subclause 4(b)(iii) of The Public Works Act is amended by striking out ", and developmental centres as defined in The Adults Living with an Intellectual Disability Act,".
Consequential amendment, C.C.S.M. c. S150
8 Subsection 1(1) of The Smoking and Vapour Products Control Act is amended in clause (c) of the definition "group living facility" by striking out ", a facility as defined in The Mental Health Act, or the Manitoba Developmental Centre" and substituting "or a facility as defined in The Mental Health Act".
THE ANATOMY ACT
C.C.S.M. c. A80 amended
9(1) The French version of The Anatomy Act is amended by this section.
9(2) Subsection 16(1) is amended by replacing the part after clause (d) with the following:
le directeur ou autre dirigeant, ou la personne ayant la responsabilité ou la garde, doit immédiatement donner avis du décès à l'inspecteur ou au sous-inspecteur de la division ou section à l'intérieur de laquelle le décès est survenu; il ou elle doit aussi, dans les 24 heures après le décès, envoyer par courrier ou délivrer un avis écrit du décès, signé par lui ou elle, à l'inspecteur ou au sous-inspecteur.
9(3) Subsection 18(1) is amended by striking out everything after "cette personne," and substituting "et de tous les faits qui lui ont été rapportés, à l'université.".
THE ARBITRATION ACT
C.C.S.M. c. A120 amended
10 Section 48 of The Arbitration Act is amended by adding "The application for leave to appeal must be made not later than 30 days after the date of the court's decision." at the end.
THE ARCHITECTS ACT
C.C.S.M. c. A130 amended
11 Subsection 1(1) of the French version of The Architects Act is amended in the definition "architecte" by striking out "que lui-même" and substituting "qu'elle-même".
THE ARCHIVES AND RECORDKEEPING ACT
C.C.S.M. c. A132 amended
12 Section 14 of The Archives and Recordkeeping Act is amended, in the part before clause (a), by striking out "a child and family services agency established under" and substituting "an agency as defined in".
THE MANITOBA ASSISTANCE ACT
C.C.S.M. c. A150 amended
13 Section 1 of The Manitoba Assistance Act is amended in the definition "agency" by striking out "a child caring agency" and substituting "an agency".
THE BUILDERS' LIENS ACT
C.C.S.M. c. B91 amended
14(1) The Builders' Liens Act is amended by this section.
14(2) Section 47 of the English version is amended by striking out everything after "a contractor" and substituting "or a sub-contractor, it shall be deemed to have been given to the owner, contractor or sub-contractor, as the case may be.".
14(3) Subsection 110(1) is amended by striking out "provide the proposed adjudicator with" and substituting "give the proposed adjudicator".
14(4) Subsection 110(2) is amended by striking out "provided" and substituting "given".
THE CHILD SEXUAL EXPLOITATION AND HUMAN TRAFFICKING ACT
C.C.S.M. c. C94 amended
15 Subclause 3(1)(b)(ii) of The Child Sexual Exploitation and Human Trafficking Act is amended by striking out "a child and family services agency mandated under" and substituting "an agency as defined in".
THE CONSUMER PROTECTION ACT
C.C.S.M. c. C200 amended
16(1) The French version of The Consumer Protection Act is amended by this section.
16(2) Subsection 149(7) is amended by adding ", notamment les obligations qui y sont liées" at the end.
16(3) Subsection 252(6) is amended by striking out "en cause" and substituting ", notamment les obligations qui y sont liées".
THE COURT OF KING'S BENCH ACT
C.C.S.M. c. C280 amended
17 Subsection 72.1(5) of The Court of King's Bench Act is amended by striking out "or" at the end of clause (c), adding "or" at the end of clause (d) and adding the following after clause (d):
(e) a foreign order sought to be registered under The International Child Support and Family Maintenance (Hague Convention) Act.
THE COURT OF KING'S BENCH SMALL CLAIMS PRACTICES ACT
C.C.S.M. c. C285 amended
18 Section 18 of the French version of The Court of King's Bench Small Claims Practices Act is amended by striking out "une garantie pour les frais" and substituting "un cautionnement pour frais".
THE EMERGENCY MEASURES ACT
C.C.S.M. c. E80 amended
19(1) The Emergency Measures Act is amended by this section.
19(2) Clause 2(3)(a) is repealed.
19(3) Section 6 is amended by adding the following after clause (a):
(a.1) respecting the qualifications and training requirements that a person appointed by a local authority under clause 8(1)(c) must meet;
19(4) Section 6 is further amended by renumbering it as subsection 6(1) and adding the following as subsection 6(2):
Co-ordinator may approve courses
6(2) A regulation made under clause (1)(a.1) may authorize the co-ordinator to approve specific training courses and to exempt persons from the requirement to take training courses.
19(5) Clause 8(1)(c) is amended by striking out "shall appoint a person and prescribe the duties of that person including" and substituting "shall, subject to the regulations, appoint a person and prescribe the person's duties, including".
19(6) Subsection 16.1(1) is amended by striking out everything after "in accordance with the" and substituting "regulations and guidelines for disaster assistance.".
19(7) The following is added after subsection 16.1(2):
Disaster assistance regulations
16.1(3) The Lieutenant Governor in Council may make regulations respecting disaster assistance, including regulations
(a) establishing and delivering disaster assistance programs;
(b) assessing the amount of disaster assistance that may be paid for disaster assistance claims.
Disaster assistance guidelines
16.1(4) The co-ordinator may issue guidelines about receiving, assessing and disposing of disaster assistance claims, including guidelines for assessing the amount of disaster assistance that may be paid for disaster assistance claims. The guidelines must not be inconsistent with this Act or the regulations.
THE ENVIRONMENT ACT
C.C.S.M. c. E125 amended
20(1) The Environment Act is amended by this section.
20(2) Subsection 1(2) is amended by repealing the definition "medical officer of health".
20(3) Subsection 33(1) is amended, in the part before clause (a), by striking out "person" and substituting "individual".
THE EXECUTIVE GOVERNMENT ORGANIZATION ACT
C.C.S.M. c. E170 amended
21(1) The English version of The Executive Government Organization Act is amended by this section.
21(2) Subsection 10(1) is amended, in the part after clause (e), by striking out "him" and substituting "the minister".
21(3) Subsection 10(2) is amended
(a) by striking out "to him";
(b) by striking out "himself"; and
(c) by striking out ", him" and substituting ", the minister".
THE FAMILY PROPERTY ACT
C.C.S.M. c. F25 amended
22(1) The French version of The Family Property Act is amended by this section.
22(2) Subsection 7(1) is amended by striking out "aux deux" and substituting "dans le but d'avantager les deux".
22(3) Subsection 7(4) is amended by striking out "afin" and substituting "dans le but".
THE FAMILY SUPPORT ENFORCEMENT ACT
C.C.S.M. c. F26 amended
23 Subsection 31(5) of the French version of The Family Support Enforcement Act is amended by striking out "particulières" and substituting "spéciales".
THE MANITOBA FILM AND SOUND RECORDING DEVELOPMENT CORPORATION ACT
C.C.S.M. c. F54 amended
24(1) The Manitoba Film and Sound Recording Development Corporation Act is amended by this section.
24(2) The title is replaced with "THE MANITOBA FILM AND MUSIC CORPORATION ACT".
24(3) The following provisions are amended by striking out "Manitoba Film and Sound Recording Development Corporation" and substituting "Manitoba Film and Music Corporation":
(a) section 1 in the definition "corporation";
(b) section 2.
Consequential amendment, C.C.S.M. c. I10
25 The following definitions in subsection 7.5(1) of The Income Tax Act are amended by striking out "Manitoba Film and Sound Recording Development Corporation" and substituting "the Manitoba Film and Music Corporation":
(a) "certifying authority";
(b) "government assistance" in clause (b).
THE FUEL TAX ACT
C.C.S.M. c. F192 amended
26 Subsection 8(2) of The Fuel Tax Act is amended by striking out "clause (1)(a)" and substituting "any of clauses (1)(a)".
THE GOVERNMENT NOTICES MODERNIZATION ACT (VARIOUS ACTS AMENDED)
S.M. 2018, c. 28 (unproclaimed provisions repealed)
27 Sections 5, 8, 9, 13, 14, 18, 19, 22, 24 and 27 of The Government Notices Modernization Act (Various Acts Amended), S.M. 2018, c. 28, are repealed.
THE HIGHWAY TRAFFIC ACT
C.C.S.M. c. H60 amended
28(1) The French version of The Highway Traffic Act is amended by this section.
28(2) Subsection 1(1) is amended in clause (a) of the definition "circulation" by striking out "locomotion" and substituting "transport".
28(3) Subsection 76.1(6) is amended by striking out "Avant de prendre les mesures que le paragraphe (4) ou (5) autorise" and substituting "Avant de se prévaloir des paragraphes (4) ou (5)".
28(4) Subsection 264(1) is amended in the part before clause (a) of the definition "infraction visée se rapportant à l'obtention de services sexuels ou au proxénétisme" by striking out "conduit" and substituting "conduisait".
28(5) Subsection 264(6.1) is replaced with the following:
Suspension en cas d'infraction visée se rapportant à l'obtention de services sexuels ou au proxénétisme
264(6.1) La personne déclarée coupable d'une infraction visée se rapportant à l'obtention de services sexuels ou au proxénétisme se voit imposer la suspension de son permis de conduire et de son droit d'obtenir un tel permis, et il lui est interdit de conduire un véhicule automobile, pour une des périodes suivantes :
a) un an à partir de la date de la condamnation, si au cours des 10 ans précédant la date de l'infraction elle n'a pas été reconnue coupable d'une telle infraction;
b) deux ans à partir de la date de la condamnation, si au cours des 10 ans précédant la date de l'infraction elle a été reconnue coupable d'une telle infraction.
THE INTERNATIONAL CHILD SUPPORT AND FAMILY MAINTENANCE (HAGUE CONVENTION) ACT
C.C.S.M. c. I61 amended
29(1) The International Child Support and Family Maintenance (Hague Convention) Act is amended by this section.
29(2) Section 11 is replaced with the following:
Declaration re application of Convention to other child support obligations
11 In accordance with the declaration made by Canada with respect to Manitoba under Article 2(3) of the Convention, the Convention extends to applications respecting child support obligations toward persons who are 21 years of age or older and are unable, by reason of illness, disability or other cause, including but not limited to enrolment in a full-time program of education, to withdraw from their parents' charge or to obtain the necessaries of life. The definition "child" as defined in section 56 of The Family Law Act applies to such applications.
29(3) Section 12 is amended by striking out "If Canada makes a declaration" and substituting "In accordance with the declaration made by Canada".
29(4) Section 13 is amended, in the part before item 1,
(a) by striking out "If Canada makes a reservation" and substituting "In accordance with the reservation made by Canada"; and
(b) by striking out "Article 20(1)(c)" and substituting "Articles 20(1)(c)".
29(5) Section 14 is amended by striking out "If Canada makes a declaration in respect of" and substituting "In accordance with the declaration made by Canada with respect to".
THE PESTICIDES AND FERTILIZERS CONTROL ACT
C.C.S.M. c. P40 amended
30(1) The Pesticides and Fertilizers Control Act is amended by this section.
30(2) Subsection 2(1) is amended
(a) in the English version, by striking out "distribution," and substituting "distribution"; and
(b) by striking out "he first obtains" and substituting "the person does so in accordance with the regulations and the person first obtains".
30(3) Subsection 2(2) is amended by striking out "he first obtains" and substituting "the person does so in accordance with the regulations and the person first obtains".
30(4) Subsection 2(2.1) is amended by striking out "he or she first obtains" and substituting "the person does so in accordance with the regulations and the person first obtains".
30(5) Section 3 of the English version is amended
(a) by striking out "distribute," and substituting "distribute"; and
(b) by striking out "or is likely to, resell it in the normal course of the other person's" and substituting "or is likely to resell it in the normal course of that other person's".
30(6) Subsection 4(4) is amended by striking out "Agriculture" and substituting "Health".
THE POLICE SERVICES ACT
C.C.S.M. c. P94.5 amended
31(1) The Police Services Act is amended by this section.
31(2) The following is added as Division 4 of Part 7:
DIVISION 4
DEFINITIONS
Definitions
77 The following definitions apply in this Part.
"affected person" means a person whose involvement with a police officer resulted in an investigation by the independent investigation unit. (« personne touchée »)
"complaint" means an allegation made orally or in writing, if the person making the allegation provides their name and contact information. (« plainte »)
"police associate" means
(a) a civilian employed by a police service;
(b) a person who is employed by a municipality, First Nation or entity representing a group of First Nations and who provides services to or for a police service; and
(c) a prescribed person or a member of a prescribed class of persons. (« personne affiliée à un service de police »)
"subject officer" means a police officer who, in the opinion of the civilian director,
(a) may have caused the death of a person;
(b) may have caused a serious injury to a person;
(c) may have contravened a provision prescribed under clause 65(1)(c) or subsection 73(1) or (1.1); or
(d) may have engaged in other conduct that is the subject of an investigation by the independent investigation unit. (« agent impliqué »)
31(3) The following is added before section 77.12 as part of Part 7.2:
First Nation safety officer program
77.11.1 A First Nation, an entity representing a group of First Nations or a First Nation police service may operate a First Nation safety officer program in accordance with this Part.
31(4) Subsection 77.12(1) is replaced with the following:
Agreement to operate safety officer program
77.12(1) A First Nation, an entity representing a group of First Nations or a First Nation police service that seeks to operate a First Nation safety officer program under this Part must enter into an agreement with the minister respecting the operation of the program.
Consultation requirement
77.12(1.1) Before entering into an agreement under subsection (1), a First Nation or entity representing a group of First Nations must consult with the local policing authority respecting the proposed First Nation safety officer program.
31(5) The definition "operator of a First Nation safety officer program" in section 77.22 is amended by striking out "the First Nation or entity representing a group of First Nations" and substituting "the First Nation, the entity representing a group of First Nations or the First Nation police service".
THE POLICE SERVICES AMENDMENT ACT
S.M. 2023, c. 27 amended
32 Section 24 of the French version of The Police Services Amendment Act, S.M. 2023, c. 27, is amended by adding "la deuxième occurrence de" after "après".
THE POLICE SERVICES AMENDMENT ACT (ENHANCING INDEPENDENT INVESTIGATION UNIT OPERATIONS)
S.M. 2022, c. 10 amended (unproclaimed provision repealed)
33 Section 17 of The Police Services Amendment Act (Enhancing Independent Investigation Unit Operations), S.M. 2022, c. 10, is repealed.
THE PRESCRIPTION DRUGS COST ASSISTANCE ACT
C.C.S.M. c. P115 amended
34 Section 1 of The Prescription Drugs Cost Assistance Act is amended by striking out "clause 8.2(1)(a)" and substituting "section 8.2" in the following definitions:
(a) "product agreement" in clause (b);
(b) "specified drug".
Consequential amendment, C.C.S.M. c. P60
35 Section 77 of The Pharmaceutical Act is amended in clause (b) of the definition "product agreement" by striking out "clause 8.2(1)(a)" and substituting "section 8.2".

36 Section 1 of The Provincial Offences Act is amended in the definition "enactment" by striking out "The Regulations Act" and substituting "The Statutes and Regulations Act".
THE PUBLIC INTEREST DISCLOSURE (WHISTLEBLOWER PROTECTION) ACT
C.C.S.M. c. P217 amended
37 Clause (c) of the definition "government body" in section 2 of The Public Interest Disclosure (Whistleblower Protection) Act is replaced with the following:
(c) an agency as defined in The Child and Family Services Act;

38 Subsection 2(1) of The Public Libraries Act is replaced with the following:
Public Library Advisory Board
2(1) The Public Library Advisory Board is hereby continued and consists of
(a) not more than six members appointed by the Lieutenant Governor in Council; and
(b) the following ex officio members:
(i) the deputy minister of the minister's department, or their designate,
(ii) the director.

39 Clause (d) of the Schedule to The Public Sector Compensation Disclosure Act is replaced with the following:

40(1) The Securities Act is amended by this section.
40(2) Subsection 6(1) is amended
(a) in the section heading of the English version, by striking out "Persons who" and substituting "Persons and companies that"; and
(b) by adding "or company" after "person" wherever it occurs.
40(3) Subclause 28(1)(b)(iv) is amended by adding "or (1.1)" after "subsection 148.1(1)".
40(4) Subsection 148.1(2) is amended by striking out "subsection (1)" and substituting "subsection (1) or (1.1)".
THE STATUTES AND REGULATIONS ACT
C.C.S.M. c. S207 amended
41 Subsection 34.3(5) of the English version of The Statutes and Regulations Act is replaced with the following:
Opportunity for public consultation required by other statute
34.3(5) If another statute requires a minister or other person or body to provide an opportunity for public consultation regarding a proposed regulation, this section does not apply.
THE VITAL STATISTICS ACT
C.C.S.M. c. V60 amended
42 The French version of The Vital Statistics Act is amended by striking out "nom et prénom" and substituting "noms et prénoms" in the following provisions:
(a) item 3 of subsection 25(5);
(b) item 2 of subsection 25(6);
(c) clause (a) of item 2 of subsection 25(8).
THE WATER POWER ACT

43 Subsection 14(5) of The Water Power Act is amended by adding "fiscal" before "year".
THE WATER RESOURCES ADMINISTRATION ACT
C.C.S.M. c. W70 amended
44(1) The Water Resources Administration Act is amended by this section.
44(2) The following is added after section 3:
Delegation of authority
3.1 The minister may, in writing, delegate to one or more employees of the department over which the minister presides any of the powers and duties conferred on the minister under this Act or the regulations, other than the powers and duties of the minister with respect to
(a) operating guidelines under subsection 5.1(1);
(b) advisory committees under subsection 5.3(1);
(c) agreements with other governments under subsection 6(2);
(d) public water control works in unorganized territories under section 8;
(e) use of lands by local authorities under subsection 9(3);
(f) dealing with land under The Crown Lands Act under section 10.2;
(g) artificial flooding reports under section 12.7;
(h) temporarily restricting access to provincial water infrastructure under subsection 15.6(2);
(i) evacuation orders under subsection 18(1); and
(j) requiring the delivery of plans, etc. under section 21.
44(3) The centred heading "REGULATIONS" is added after section 25.1.

45 Clause 3(1)(c) of the French version of The Water Rights Act is amended by adding "d'établir," after "de construire,".

46 Subsection 45.1(2) of The Watershed Districts Act is amended by striking out "subsection 7(2)" and substituting "subsection 8(2)".

S.M. 2023, c. 20 amended
47(1) The Wildfires Amendment Act, S.M. 2023, c. 20, is amended by this section.
47(2) Subsection 18(1) of the English version is replaced with the following:

(a) in the section heading, by striking out "Canadian Transport Agency" and substituting "Transport Canada"; and
(b) by striking out "the Canadian Transport Agency" and substituting "Transport Canada".

THE WILDLIFE ACT
C.C.S.M. c. W130 amended
48(1) The Wildlife Act is amended by this section.
48(2) Subsection 40(3) is amended by striking out "prescribe" and substituting "impose".
48(3) Section 47 is amended
(a) in clause (b), by striking out "valid, subsisting seal, shipping coupon or tag" and substituting "game tag"; and
(b) in subclause (c)(i), by striking out "a shipping coupon or tag" and substituting "the game tag".
48(4) Subsection 48(4) is amended by striking out "seal or coupon issued as part of the licence" and substituting "game tag issued with the licence".
48(5) Subsection 55(2) is repealed.
48(6) Subsection 55(3) is replaced with the following:
Terms and conditions
55(3) A licence or permit may be subject to terms and conditions
(a) imposed by regulation; or
(b) imposed by the minister on that specific licence or permit.
48(7) Subsection 55(4) is amended by striking out "prescribe" and substituting "impose".
48(8) Section 65 is amended, in the part before clause (a), by striking out "prescribe" and substituting "impose".
48(9) Clause 90(b) is amended by striking out "any coupon, tag or seal prescribed by the minister for use under this Act" and substituting "a game tag or seal".
PART 2
COMING INTO FORCE
Coming into force — royal assent
49(1) Subject to subsections (2) to (4), this Act comes into force on the day it receives royal assent.
Coming into force — proclamation
49(2) Subsection 31(2) comes into force on a day to be fixed by proclamation.
Coming into force — November 7, 2024
49(3) Section 41 is deemed to have come into force on November 7, 2024.
Coming into force — April 1, 2024
49(4) Section 47 is deemed to have come into force on April 1, 2024.
