THE EARLIER SCREENING FOR BREAST CANCER ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definition

1   In this Act, "minister" means the minister responsible for the administration of The Public Health Act.

Screening eligibility age

2   The minister must develop and implement a plan to ensure that the initial eligibility age for routine breast cancer screening services without a referral — as provided through the BreastCheck program of CancerCare Manitoba or the successor to that program — is lowered from 50 years of age to 40 years of age by no later than December 31, 2026.

Annual report

3(1)   Within six months after the end of each fiscal year of the government, the minister must prepare and publish a report on the status of the plan referred to in section 2.

Content of report

3(2)   The report must include the number of screening mammograms performed in Manitoba during that fiscal year.

Tabling report in Assembly

3(3)   The minister must table a copy of the report in the Assembly on any of the first 15 days on which the Assembly is sitting after the minister completes it.

Application after screening age lowered

3(4)   This section ceases to apply five years after the day the initial eligibility age for routine breast cancer screening services without a referral is lowered to 40 years of age.

4   This Act may be referred to as chapter E2 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

5   This Act comes into force on the day it receives royal assent.

Explanatory Note

The Earlier Screening for Breast Cancer Act requires the minister to develop and implement a plan to lower the initial eligibility age for routine breast cancer screening services without a referral from 50 years to 40 years by no later than December 31, 2026.

The minister must report annually on the status of the plan, including the number of screening mammograms performed.
