THE RECIPROCAL ENFORCEMENT OF JUDGMENTS AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. J20 amended

1   The Reciprocal Enforcement of Judgments Act is amended by this Act.

2(1)   Subsection 3(6) is amended by adding "or" at the end of clause (g) and adding the following after clause (g):

(h) the judgment is contrary to the public policy of Manitoba as set out in subsection (6.1).

2(2)   The following is added after subsection 3(6):

Foreign judgment re pregnancy termination not enforceable

3(6.1)   A judgment of an original court outside Manitoba in respect of the provision of lawful medical services in Manitoba for the termination of pregnancy, including prescribing, dispensing or administering a drug to terminate pregnancy, is hereby deemed to be contrary to public policy.

Coming into force

3   This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Reciprocal Enforcement of Judgments Act to prohibit registering and enforcing a civil judgment of a court outside Manitoba concerning abortion services provided in Manitoba.
