THE ORANGE SHIRT DAY STATUTORY HOLIDAY ACT (VARIOUS ACTS AMENDED)

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. E110 amended

1   The definition "general holiday" in subsection 21(1) of The Employment Standards Code is amended by adding the following after clause (e):

(e.1) Orange Shirt Day (September 30);

C.C.S.M. c. I80 amended

2   Subsection 23(1) of The Interpretation Act is amended by adding the following after item 6:

6.1

September 30, known as "Orange Shirt Day"

C.C.S.M. c. C150.5 amended

3   Schedule 32 of The Commemoration of Days, Weeks and Months Act is amended in the preamble by adding the following after the fourth paragraph:

AND WHEREAS the Government of Canada has created a federal statutory holiday on September 30 to honour First Nations, Inuit and Metis survivors and their families and communities;

Coming into force

4   This Act comes into force on the day it receives royal assent.

Explanatory Note

One of the calls to action of the Truth and Reconciliation Commission of Canada was the creation of a federal statutory holiday on September 30. The holiday honours survivors of residential schools, their families and communities and ensures that public commemoration of the history and legacy of residential schools remains a vital component of the reconciliation process.

This Bill recognizes Orange Shirt Day, September 30, as a provincial statutory holiday for the purposes of The Employment Standards Code and The Interpretation Act.
