THE WORKERS COMPENSATION AMENDMENT ACT (WILDFIRE FIREFIGHTERS)

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. W200 amended

1   The Workers Compensation Act is amended by this Act.

2(1)   Subsection 4(5.1) is amended by adding the following definition:

"wildfire firefighter" means a worker employed to suppress or extinguish wildfires as defined in section 1 of The Wildfires Act and who is not a full-time firefighter, a part-time firefighter or a member of OFC personnel. (« pompier affecté aux incendies échappés »)

2(2)   Subsection 4(5.2) is amended, in the part before clause (a), by striking out "full-time firefighter, a part-time firefighter" and substituting "full-time, part-time or wildfire firefighter".

2(3)   Subsection 4(5.3) is amended

(a) in clause (a), by striking out "full-time firefighter, a part-time firefighter" and substituting "full-time, part-time or wildfire firefighter"; and

(b) in clause (b), by striking out ", other than a forest-fire scene,".

2(4)   Subsection 4(5.5) is amended by striking out "or" at the end of clause (a), adding "or" at the end of clause (b) and adding the following after clause (b):

(c) wildfire firefighters on or after the day this clause comes into force.

2(5)   Subsection 4(5.6) is amended by striking out "full-time firefighter, a part-time firefighter" and substituting "full-time, part-time or wildfire firefighter".

2(6)   Subclause 4(5.7)(a)(ii) is amended by adding ", wildfire firefighters" after "part-time firefighters".

Coming into force

3   This Act comes into force on a day to be fixed by proclamation.

Explanatory Note

The Workers Compensation Act lists heart injuries and specific cancers presumed to be caused by firefighting unless the contrary is proven. This Bill amends the Act to extend the presumptions to wildfire firefighters.
