THE REGULATED HEALTH PROFESSIONS AMENDMENT ACT (2)

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
1 The Regulated Health Professions Act is amended by this Act.
2 The following is added as section 163.1 and before the centred heading "INQUIRY":
163.1 The following definitions apply in this Part.
"association" means an association or corporation established or continued by a profession-specific Act. (« association »)
"board" means the board of a college established or continued by a profession-specific Act or an association. (« conseil »)
"college" means
(a) a college established or continued by a regulation under clause 8(b); or
(b) a college established or continued by a profession-specific Act. (« ordre professionnel »)
"council" means
(a) the council of a college established by subsection 12(1); or
(b) the council of a college established or continued by a profession-specific Act or an association. (« conseil »)
"profession-specific Act" means an Act listed in Schedule 2 that has not been repealed. (« loi particulière »)
"regulated health profession" means a health profession
(a) designated as a regulated health profession by a regulation under clause 8(a); or
(b) regulated under a profession-specific Act. (« profession de la santé réglementée »)
3(1) Subsection 164(1) is amended
(a) in the part before clause (a),
(i) by striking out "college or colleges" and substituting "college or association", and
(ii) in the English version, by striking out "he or she" and substituting "the minister"; and
(b) in clause (a), by striking out "college or colleges" and substituting "college or association".
3(2) Subsection 164(2) is amended by adding "or under a profession-specific Act or the regulations or by-laws made under that Act" at the end.
3(3) Subsection 164(5) is amended by adding "or association" after "college" wherever it occurs.
4(1) Subsection 165(1) is amended, in the part before clause (a), by adding "or association" after "college".
4(2) Subsection 165(2) is amended
(a) in clause (a),
(i) in the English version, by adding "or board" after "council", and
(ii) by adding ", or under a profession-specific Act or the regulations or by-laws made under that Act" after "or the by-laws"; and
(b) in clauses (b) and (c) of the English version, by adding "or board" after "council" wherever it occurs.
4(3) Subsection 165(3) of the English version is amended, in the part before clause (a), by adding "or board" after "council".
4(4) Subsection 165(4) of the English version is amended
(a) by adding "or board" after "Council" in the section heading; and
(b) by adding "or board" after "council".
4(5) Subsection 165(5) of the English version is amended by adding "or board" after "council" wherever it occurs.
5(1) Subsection 166(1) is amended
(a) in the section heading of the French version, by striking out "d'un administrateur" and substituting "d'administrateurs";
(b) in the part before clause (a), by adding "or association" after "college";
(c) in clause (a), by adding "or association" after "college";
(d) in clause (b), by striking out "college's" and substituting "college or association's"; and
(e) by replacing clause (c) with the following:
(c) authorize a person appointed as an administrator to carry out, as specified in the order, any of the powers and duties of the college or association, its council or board, officers or committees under this Act or the regulations and by-laws or under a profession-specific Act or the regulations and by-laws made under that Act.
5(2) Subsection 166(2) is amended
(a) in clause (a), by adding "or association" after "college"; and
(b) in clause (b),
(i) by adding "or association" after "college" wherever it occurs, and
(ii) by adding "or under a profession-specific Act or the regulations and by-laws made under that Act" after "by-laws" wherever it occurs.
5(3) Subsection 166(3) is amended
(a) in the English version, by replacing the section heading with "Administrator deemed to be carrying out duty";
(b) by adding "or association," after "college"; and
(c) in the English version, by adding "or board" after "council".
5(4) Subsection 166(4) of the English version is amended by striking out "his or her" and substituting "the administrator's".
6 Subsection 168(2) of the English version is amended, in the part after clause (b), by striking out "regional".
7 This Act comes into force on the day it receives royal assent.
