THE REDUCING RED TAPE AND IMPROVING SERVICES ACT, 2023

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

THE AMUSEMENTS ACT

C.C.S.M. c. A70 amended

1   Section 60 of The Amusements Act is repealed.

THE CITY OF WINNIPEG CHARTER

S.M. 2002, c. 39 amended

2(1)   The City of Winnipeg Charter is amended by this section.

2(2)   The following provisions are amended by striking out "by ordinary mail":

(a) subsection 228(2) in the part before clause (a);

(b) clause 230(1)(a) in the part before subclause (i);

(c) subsection 236.1(6) in the part before clause (a);

(d) clause 250(1)(a);

(e) subsection 250(2);

(f) clause 251(3)(a) in the part before subclause (i).

2(3)   The following is added after section 276:

NOTICES

Sending notice

276.1(1)   When any notice or other document under this Part must be given or sent to a person, it may be

(a) personally delivered to the person;

(b) sent by ordinary mail to the person; or

(c) sent by e-mail or other method of electronic communication to the person, but only if the person has agreed in writing that the notice or document may be sent to the person by e-mail or other method of electronic communication.

Deemed receipt

276.1(2)   A notice or other document sent by ordinary mail to a person is deemed to be received by the person on the third day after it is mailed.

2(4)   The following provisions are amended by striking out "by ordinary mail":

(a) subsection 280(3) in the part before clause (a);

(b) section 282 in the part before clause (a);

(c) clause 282.1(5)(a) in the part before subclause (i).

Consequential amendments, S.M. 2022, c. 27 (unproclaimed)

3(1)   The City of Winnipeg Charter Amendment and Planning Amendment Act, S.M. 2022, c. 27, is amended, insofar as it amends The City of Winnipeg Charter, by this section.

3(2)   Section 17 is amended, insofar as it enacts clauses 234.3(1)(b) and 234.4(1)(a) and subclause 234.4(1)(b)(ii), by striking out "by ordinary mail".

3(3)   Subsection 22(3) is amended, insofar as it enacts clause 246(1.1)(a), by striking out ", by ordinary mail".

3(4)   Subsection 22(5) is amended, insofar as it enacts subsection 246(1.2.1), by striking out ", by ordinary mail,".

3(5)   Subsection 25(2) is amended

(a) insofar as it enacts clause 275(1.1)(a), by striking out ", by ordinary mail"; and

(b) insofar as it enacts subsection 275(1.3), by striking out ", by ordinary mail,".

THE HIGHWAY TRAFFIC ACT

C.C.S.M. c. H60 amended

4(1)   The Highway Traffic Act is amended by this section.

4(2)   Subsection 1(1) is amended

(a) by replacing clause (g) of the definition "emergency vehicle" with the following:

(g) a vehicle not ordinarily used for emergency purposes that is used to respond to a fire, medical or other emergency by

(i) a volunteer, part-time or on-call emergency responder, or

(ii) a person who is not an emergency responder but who has been assigned emergency response duties by a fire department;

(b) in the definition "government emergency organization", by striking out "Emergency Health Unit of the Department of Health, Healthy Living and Seniors" and substituting "Department of Health"; and

(c) by adding the following definition:

"emergency responder" means

(a) a firefighter, or

(b) an emergency medical responder or paramedic certified to practise by the College of Paramedics of Manitoba; (« intervenant d'urgence »)

4(3)   Subsection 76(1) is amended

(a) in the section heading, by striking out "firefighter" and substituting "emergency responder"; and

(b) in clause (b), by striking out "a firefighter who in the course of his or her" and substituting "an emergency responder who in the course of their".

4(4)   Subsection 76(2) is amended, in the part before clause (a), by striking out "firefighter" wherever it occurs and substituting "emergency responder".

4(5)   Subsection 76(3) is amended

(a) in the section heading, by striking out "firefighter's" and substituting "emergency responder's"; and

(b) in clauses (a) and (b), by striking out "firefighter" and substituting "emergency responder".

4(6)   Subsection 76(5) is amended

(a) in the section heading, by striking out "Firefighter's" and substituting "Emergency responder's";

(b) in the part before clause (a), by striking out "A firefighter" and substituting "An emergency responder";

(c) in clause (b) of the English version, by striking out "his or her" and substituting "the police officer's"; and

(d) in the French version, by striking out "agent de la paix" and substituting "agent de police".

4(7)   Subsection 106(1) is amended by adding "or" at the end of clause (b) and replacing clause (b.1) with the following:

(b.1) the driver of any vehicle who is accompanied by a peace officer or is driving a vehicle that is escorted by a vehicle driven by a peace officer;

4(8)   Clause 180(2.1)(b) is replaced with the following:

(b) to respond to a fire, medical or other emergency by

(i) a volunteer, part-time or on-call emergency responder, or

(ii) a person who is not an emergency responder but who has been assigned emergency response duties by a fire department.

THE TEACHERS' PENSIONS ACT

C.C.S.M. c. T20 amended

5(1)   The Teachers' Pensions Act is amended by this section.

5(2)   Subsection 1(1) is amended by adding the following definition:

"approved form" means a form approved by or acceptable to the board; (« formule approuvée »)

5(3)   Subsection 11(1) is amended, in the part before clause (a), by striking out "in a form prescribed in the regulations, before he or she becomes entitled to receive a pension under section 6 or 9, or before he or she begins" and substituting "in an approved form, before they become entitled to receive a pension under section 6 or 9, or before they begin".

5(4)   Subsection 40(1) is amended by striking out "unless he applies therefor in writing in the proper form prescribed in the regulations" and substituting "unless they apply in writing in an approved form".

5(5)   Subsection 41(11) is replaced with the following:

By-laws

41(11)   The board must adopt by-laws, not inconsistent with this Act, respecting procedures of the board and the conduct of its affairs, including

(a) the number of meetings to be held in a year;

(b) the calling of meetings, including notice of meetings;

(c) the conduct of meetings, including rules of procedure and voting; and

(d) the keeping of minutes and the recording of by-laws.

Power to approve forms

41(11.1)   The board may approve any forms the board considers necessary for use under this Act.

5(6)   Subsection 41.1(2) is amended, in the part before clause (a), by striking out "regulations" and substituting "by-laws or regulations".

5(7)   Subsection 63.3(2) of the English version is amended

(a) in the part before clause (a), by striking out "he or she" and substituting "the teacher"; and

(b) in subclause (b)(i), by striking out "his or her" and substituting "their".

5(8)   Clause 73(a) is repealed.

5(9)   Subsection 74(6) of the French version is amended by striking out "formule approuvée par la Commission" and substituting "formule que la Commission approuve".

5(10)   The provisions of The Teachers' Pensions Act listed in the Schedule to this Act are amended as specified in the Schedule.

COMING INTO FORCE

Coming into force — royal assent

6(1)   Subject to subsection (2), this Act comes into force on the day it receives royal assent.

Coming into force — section 5

6(2)   Section 5 comes into force on a day to be fixed by proclamation.

Explanatory Note

This Bill amends several Acts to reduce or eliminate regulatory requirements or prohibitions, to improve services and to streamline government operations.

The Amusements Act

The Amusements Act is amended to eliminate the prohibition on reselling tickets at a markup.

The City of Winnipeg Charter

The City of Winnipeg Charter and The City of Winnipeg Charter Amendment and Planning Amendment Act are amended to permit planning notices to be sent electronically.

The Highway Traffic Act

The Highway Traffic Act is amended to

give paramedics and emergency medical responders the same authority as firefighters to direct traffic; and

eliminate an exception that allowed vehicles, other than emergency vehicles, to disregard speed limits, stop signals and other traffic control devices if carrying first aid or rescue equipment.

The Teachers' Pensions Act

The Teachers' Pensions Act is amended to allow the Teachers' Retirement Allowances Fund Board to set its own board procedures and adopt forms to be used for administration of the Teachers' Retirement Allowances Fund.
